The RW fetal person-hood corps just caught a big break in Colorado Shooting

One of the victims who was paralyzed was pregnant. She subsequently miscarried. There will not be an additional homicide charge because under Colorado law (and most law, I'd guess) a baby has to be born to be a person.

So this will be a big RW talking point.

I have always been troubled by the idea that a non-voluntary abortion (whether medical or the result of violence) is not a distinct crime. It seems that punching a pregnant woman in the gut, resulting in miscarriage, ought to be more serious than just punching someone.

It does not require that the fetus be a person. (That would be a very bad thing.) It would be categorized as a crime against the mother—a category of aggravated assault.

An assault law can have a higher penalty for blinding someone, for instance. So include miscarriage as an aggravating circumstance carrying a higher sentence.

That protects the interests of mothers without threatening choice.

Yes, it could be made a crime against the mother, affording the same kind of protections. yardwork Jul 2012 #1

You are mistaken. Most states including California have "fetal homicide" laws. slackmaster Jul 2012 #10

Unfortunately, the right wing is not interested in protecting the rights of mothers. They aren't really interested in protecting the rights of unborn babies, either. If they were interested in either of those things they would be passing laws to protect women instead of taking domestic violence laws off the books, as many jurisdictions are now doing. If they were interested in protecting women and babies the right-wing would be promoting health and social safety nets.

The right wing is interested in protecting the rights of wealthy men, and these so-called "family values" laws they promote are nothing but a way to put more controls on women.

This is true, but ...

What I see as the big reason there is so much anti-choice nonsense is because TPTB keep it front-n-center to use as a Wedge Issue to Divide & Conquer. TPTB only care about a couple of things, and making sure the 99% never unite is the main, if not only, strategy they have to make sure their rape of the planet continues nearly unopposed.

So by some these pregnant woman sitting there waiting to have an abortion and were killed, should have their killers charged with murdering their embroys and fetuses too?

Do you really think she would be more upset having a miscarriage than having her already born child dead? No, leave it alone. Having had a tubal pregnany and a 3 year old at the same time, my 3 year old meant far, far MORE to me to any embryo or fetus.

Call me a BAD mother for my attitude if you wish, but that is how I felt, and still do after 30 years.

"Do you really think she would be more upset having a miscarriage than having her already born child dead?"

I never said anything that even remotely bears on how she feels about the death of her daughter. I assume she is against it.

In fact, I didn't say a thing about how she feels about anything.
