I'm from California, and we have good labor laws that protect workers, not in unions, from wage,

overtime and abuses that occur in the workplace. In Ca., waiters and waitress' working in restaurants are paid minimum wage, but are also allowed to keep all of the their gratuities no matter how much they get. I'm sure that in most states that don't have RTW laws are the same. While traveling in the south,this summer I was surprised to learn that in the majority of the southern states, or maybe all of them, waitresses (or waiters) are allowed to keep their tips only if they equal the hourly minimum wage. I have encountered this in southern states where it has occurred to me to ask my waiter/waitress. I purposely, now, slip my tip into the servers front pocket instead of putting it on the CC slip.

Anyone know how prevalent this is?
