Maybe I'm mistaken but I get the impression that some people seem to think that any amount of alcohol a person consumes instantly renders them helpless and unable to exercise judgment of any sort. This is ridiculous. If this were the case then alcohol would be illegal. Obviously the state thinks that people who are drunk can, to some degree and up to a certain stage of intoxication, still be held accountable for their actions, otherwise no DUI case could ever result in a conviction.
Likewise, of course a person can in principle consent to sex while drunk. It is all depends on circumstance (how much alcohol, what relationship do the involved parties have and various other factors) and at the end all boils down to common sense. Obviously forcing yourself on a comatose stranger is rape. Obviously getting wasted with your sweetheart and going all crazy, and continuing the next morning despite a terrible hang-over, is not.

(10,283 posts)and when you have an "inhibition" it may get lowered and the lowered state is just as much your "will" as was the state of being with higher inhibitions.

(1,289 posts)I came of age in the 70s and yes, even back then there were unwritten rules. If she's passed out cold you don't mess with her, roll her over so she's not lying on her back if she throws up while passed out and keep watch over her, that was the rule with the bunch I ran with.
Now, if she was drunk , awake and active, and I was in the same condition, then let the fun begin. Looking back it probably wasn't as fun as it seemed at the time

(10,362 posts)Technically neither can consent but sex happens. By the rigid definitions of rape that some believe, you would have situations where both parties are guilty of raping the other, which is a ludicrous concept.

First desire is high as well as performance.
Second, judgment is not nearly as impaired. That's why casual stoners don't drive . Risk management in the brain is still working while high for the most part

In most of these truly tortured and terrible examples on this board, underage drinking/doping begins the voluntary and slippery slope. No. Not an excuse...a Fact. Only an idiot consents to be blitzed and out of control...by definition...then holds an equally blitzed person to act unblitzed. The police likely could have and should have arrested the lot of them.
Not that 21 is any magic age, but at that age, I was a college graduate (in Southern California) and much wiser and more mature than in Jr. high and high school. If all of these posted accounts removed the element of illegal alcohol/drugs/whatever, the stories/results would change.
My parents would have "killed" me if I had have drunk in high school. Same with my selected peer group. Same with my son. Did I have encounters...in the trendy LA South Bay beaches out "clubbing"... yep ... it only took a couple of close calls to remember why getting blitzed with strangers and in public wasn't a good idea.
