"Spying" is even less defined than "torture" was.

America does not _____.

The blank is some word that has a negative connotation to all listeners, but that means something different to every listener. "Torture" "Negotiate with Terrorists" "Spy on Americans" etc..

Any journalist who does not follow with "Define that term" is a stooge.

(When they do the interviewee will usually take a somewhat aggressive chip-on-shoulder tone and repeat, "America does not _____." Probably with some finger jabbing. But the question still must be asked.)

Jay Leno isn't a journalist and can be cut some slack on the point, but nobody else can.
