"Shellie Zimmerman has declined prosecution (after consulting with her attorney)," Bracknell said.
George Zimmerman had been temporarily detained by police after Shellie Zimmerman told 911 Monday that he had threatened her and her father with a weapon.
On the 911 call, Shellie Zimmerman, who filed for divorce last week, is breathing heavily when she tells a dispatcher that Zimmerman is still at the house.
"He's in his car and he continually has his hand on his gun, and he's saying, 'Step closer.' He's just threatening all of us with his firearm," she says.

(40,211 posts)It is the decision of the State Attorney. The victim does not decide on a criminal prosecution.

(130,908 posts)how, exactly, would a State's Attorney prosecute???

(40,211 posts)complaintant. That is why in a criminal prosecution the case is called "The State of Wherever v. John Smith (or whoever)"
A criminal is prosecuted to protect the public not the victim.

(40,211 posts)the defendant. Cases can be prosecuted without the testimony of the victim. It helps if the victim cooperates, but it is not required. Mobsters are prosecuted all the time withou testimony of victims, for obvious reasons. Murderers are always prosecuted withou the testimony of the victim

(5,611 posts)A we all know, he already killed a teenager in an incident that could have been avoided entirely if Zimmerman had not followed Martin and just left Martin alone. Z's been in trouble for speeding (receiving a warning and also a ticket) at least twice since the trial. Now he is "threatening" his ex-wife and her father with his gun (at least she thought this was the case initially and called 911). Zimmerman is sadly -- I think -- another tragic incident waiting to happen.
