Washington State bans Marijuana use in establishments with a liquor license.


"The state Liquor Control Board on Wednesday adopted a rule change that makes it illegal for any liquor-licensed establishment to allow marijuana consumption of any kind on its premises.

The rule change likely goes into effect 30 days from Wednesday's unanimous board vote, said Mikhail Carpenter, a spokesman for the Liquor Control Board. That means, starting on or about Jan. 17, marijuana smokers can no longer light up on the second floor of Frankie's Sports Bar on Pacific Avenue in Olympia.

Frankie's has been allowing bar patrons to smoke marijuana in an upstairs private room for about a year. Frankie's owner, Frank Schnarr, has argued that members could smoke legally there after the passage of I-502, which made it legal for adults 21 and older to possess up to an ounce of marijuana in Washington state."

Is it or isn't it legal? This is a "private club", similar to a Hookah Bar or Cigar Club, the only places in WA State that allow smoking indoors. But the WSLCB (which now regulates Marijuana) has made it's open use illegal nearly everywhere. Parks? Nope. On the street? Nope. In your own privately owned residence? Yes. And because it remains illegal Federally, you cannot use it in a National Forest or National Park (which are, obviously, the best places to use it).

Lots of things are legal, and regulated.

Is driving legal? Yes or no? Well, yes, if you satisfy the various requirements for keeping and maintaining a license.

State regulations of things that can or can't go on in establishments licensed to serve liquor are pretty wide ranging, varied, and sometimes just weird. In some places, for example, you can't have a pool table in a place that serves liquor. Why? Hellifino, but there you are.

As in, no one enforced the ban on MJ use at the Gorge. It would be like handing out speeding tickets at the Indy 500.

I have kin in SE Indiana, AKA North Kentucky.

To me, the objectionable part is in allowing the legalization to proceed, but piling on so many regulations that legal use becomes nigh impossible.

For instance, where is a renter who lives in a smoke-free apartment building allowed to use MJ legally in WA State? At a Hookah Club?

It's not kosher to put cheese on a meat sandwich so they had two shops, right next to one another. One was a deli and the other was a dairy. So you'd go to the deli, buy a sandwich then you'd go next door and buy an 1/8# of cheese. Take it outside and put your cheese on your sandwich.

I'd open businesses next door to each other. One is a bar and the other is a private club that allows smoking and has a BYOB policy. I'd then put a door between the two businesses. Then you can drink your outside beverage and smoke up to your heart's content.

Alternately, you don't need a liquor license for a self-serve honor-bar in a private club. I know this because I'm a member of a private social club with an honor bar.

But from what I remember - Marijuana and hashish would be available and smoked in certain cafes that did not ever serve alcohol and vice versa. I think it may have been more an unofficial policy than an written law.
