Judge criticizes policy reuniting undocumented children, parents

A federal judge in Brownsville has accused the Department of Homeland Security of deliberately aiding smuggling networks by delivering children who are caught crossing at the border to their undocumented parents in the United States.

In a scathing opinion delivered last week in the trial of an immigrant smuggler, U.S. District Judge Andrew S. Hanen criticized the DHS practice of reuniting undocumented children with their parents who are known to be in the United States illegally as "a dangerous course of action" that endangers children and ultimately funds Mexican drug cartels, which control human smuggling and trafficking routes through Texas.

"This Court is quite concerned with the apparent policy of the Department of Homeland Security of completing the criminal mission of individuals who are violating the border security of the United States," Hanen wrote.

Hanen said DHS policy undermines the deterrent effect of immigration law and encourages others to take similar risks that jeopardize the safety of their children.
