In a move that could have major impacts for workers who use marijuana off-the-clock, the Colorado Supreme Court on Monday announced it will review the case of a fired medical-marijuana patient.
The court said it will look at two questions at the heart of the firing of Brandon Coats:
Does Colorado's Lawful Activities Statute protect medical-marijuana patients from being fired if they are not impaired at work?
Does Colorado's constitutional provision for medical-marijuana give registered users a right to cannabis?
Coats, a medical-marijuana patient who is wheelchair-bound as the result of a car accident, was fired from his job at Dish Network in 2010 after he tested positive for marijuana. There is no allegation Coats was stoned at work, and his attorney says he had an exemplary employment record with the company.

(4,876 posts)But eventually it will be treated like alcohol. Don't get high at work(unless you work in a dispensary) and you'll be fine.

(39,343 posts)BAC tests can tell you if you are drunk now, not if you've had a beer in the past few weeks. There needs to be tests used to tell if the person is high on cannabis at the current time and not if they've had it in weeks. Employers still have the right to not allow cannabis use, especially in states where it remains illegal and for certain jobs.

(4,876 posts)It can tell if you have smoked in the last few hours. The measurement for a DUI is .5 micrograms.. Which apparently meand you smoked sometime in the last 4 hours.. Employers have already been using the swab, and although it's not perfect it's a good start.
Colorado has done a shitload of legwork. Our Governor is a jerk who was against legalization and the guy made sure the government was all the way up the ass of the Marijuana industry. Most questions people have have already been answered, things just need to be tweaked.

(15,189 posts)The weed smokers should be able to collect disability. I have a recommendation, and I have to cheat to pass a pee test. Since that also is against the law, they should allow people like me to collect disability. Hearing throughout the years of my employment about people who can drink others under the table, including supervisors, and then be at work the next day with a hang over. I'm sick of boozers getting a free pass. Not only a free pass, but jokes all day after. I would hire smokers over drinkers ANYTIME.
