What if the SCOTUS decision to take up King was made by the left?

What if, God forbid, one or more of the liberal judges are now realizing that one of them might not be around for the 2015-16 term (Ginsburg comes to mind but it could be any of them - nothing in life is certain). Given the suddenly changed political landscape the odds that Obama may not be able to fill a vacant SCOTUS seat have obviously now increased. Perhaps they've had a "come to Jesus" moment and decided that they had better rule on some of these cases now knowing the court is not going to get any more liberal in the near future.

Remember Ruth's comment a few weeks ago that the SCOTUS had decided not to take up gay marriage yet because there was no conflict among the appeals courts? There may well have been four conservative judges who would like to overturn it but they punted. You would think the same would have applied to King, another politically charged decision, but now all of a sudden they decide to hear it.

I know conventional wisdom is they want to decide King before too many people get used to their subsidies but what if it's the left that suddenly wants to expedite it and other controversial cases, knowing that the court could be split if a vacancy comes up?

I stumbled across this article, written the day before Tuesday's election. Very interesting, why the sudden change of heart?
