He was acting in his official capacity, so he's immune from being sued directly.
They have to sue the county and Wilson, and then the county would have to demonstrate he was operating outside his official duties. Which is pretty much impossible without a conviction, much less an indictment.
If the county can't show he was operating outside his duties, then the county is the one that gets to pay.

"The protests in Toronto and Ottawa follow a decision Monday by a grand jury in the U.S. not to indict a white police officer in the shooting death of an unarmed black man, 18-year-old Michael Brown.
A riot followed and thousands of members of the National Guard have been called in to help prevent a second night of violence.
The peaceful protests in Toronto saw hundreds of demonstrators gather outside the U.S. Consulate, shouting "being black is not a crime" and other slogans against police brutality, while others held a candlelight vigil.
"Basically, I don't want to live in a world where some lives matter and some lives don't," said Christina Miniaci."

From Minneapolis high school halls to Duluth City Hall, Minnesotans Tuesday protested a grand jury's decision not to indict a Ferguson, Missouri, police officer in the shooting death of Michael Brown.
The rallies Tuesday were peaceful, although a woman was hurt late this afternoon after apparently being hit by a vehicle that drove into a crowd during protests on Lake Street in Minneapolis.

Oh ... one year my mother-in-law put Almonds in the Thanksgiving stuffing!!! Later that night around 2am, as my face swelled, and my throat was closing, I drove my self to the hospital.

A soldier is haunted when he kills someone, even though the target was an enemy soldier trying to do the same to him. It gives many of our troops PTSD. But not this guy. He has a "clear conscience." He just went about his day, planning his wedding during all that paid vacation time he got. He never lost one minute of sleep...I guess he knew McCulloch was taking good care of him.
