The IRS will be as happy to tax non-compliant businesses as it will be to tax non-compliant individuals. Though I'd hesitate to call either case "breaking the law"... people may just decide that paying the penalty makes better economic sense for them.

(56,582 posts)Nothing in ACA is a criminal provision at all. What kind of "teeth" are you looking for.
The purpose of the mandate is to make offering (for employers) and purchasing (for employees) health insurance more attractive than not.

(4,733 posts)the ACA employer mandate 'mandates' that certain size employers (basically 50+ full time equivalent employees) either provide their employees with ACA compliant health care policies at a cost to the employee of no more than 9.5% of his/her income OR pay a penalty to the government.
So, basically they can still shaft their employees if they want but have to pay a fine (to the government, not the employee, natch!)

Gee, and they wonder why people don't get out to vote for them.
