Cop responds to silent alarm, hops fence, trespasses, kills charging dog in self-defense

http://www.alternet.org/news-amp-politics/body-cam-cop-ignores-dog-sign-hops-fence-response-burglar-alarm-kills-homeowners

"The deputy arrived at Carla Gloger’s home after a silent alarm was tripped. The officer barely attempted to open the gate to her long driveway, and instead hopped a fence to get onto the property, ignoring warning signs about the woman owning dogs. Gloger maintains that the situation may have been very different had the officer opened the gate and drove up the driveway.

As he approached the home, the deputy saw Gloger’s two Rottweilers running towards him. As they did, the officer pulled out his service weapon and shot one of the animals."

...

"The deputy insists the dog came right at him and that he was “defending himself” for her dog running at him, on her property, which he trespassed on.

“I haven’t slept for days. I haven’t eaten. It’s hard for me to even come out,” Gloger told Fox13. “I freaked out. I was like, ‘oh my God, of all people, I would never think a sheriff would trespass, come over the gate, not unlatch it, and come in and just shoot my dog.'”

The department is fully defending the officer’s actions, and even going as far as saying that the dogs attacked the deputy. The sheriff clearly must have watched a different video.

“We’re negligent if we don’t go to that house and God forbid something happens to her. It’s our duty to go out there and do everything we can to ensure the safety of our citizens,” Sheriff Chris Nocco told FOX 13. “It’s an unfortunate situation that these dogs attacked our deputy.”"

1. Something's missing...

One would think if the gate could be opened, it would be a lot easier to open it than jump the fence.

Why is a cop responding to an alarm considered trespassing?

Shooting a dog is regrettable, but what alternative action should the cop have taken?

Oh, it's Alternet.

Never mind.

2. He could have used the entrance...

IMO, if there is a sign that says "you shouldn't be here", and guy ignores the regular route and goes there anyway, then this is trespassing.

EDIT:
I think, if he had gone thorugh the main-entrance and the dog had attacked him, I would have no problem with him shooting the dog.

the much easier way of getting in? It's not logical which suggests to me he couldn't get in that way.

never heard of. And that's because for Some Reason it doesn't fit within the narrow PC boundaries of News. Be pretty slim pickin' for DU without other sources of info. Thus, doesn't mean it didn't happen.

All sources have spin, and Alternent spins more to to the left than most.

Our version of Fox.

events that do not fall within the narrow scope of the MSN, then I agree. But to be dismissive just because it's from the Left...is it OK if it makes it on the regular news?

Made me think about the lady who called the cops for help in getting her "slow" son to the hospital for treatment, and because he did not appear to be normal, they shot him.

Keystone cops comes to mind, if only something they did was funny and not tragic.

5. The thing that gets me is them calling it a dog attack

There were signs posted, the dogs were contained on their property. Almost every dog is going to respond to somebody invading their territory and going over the fence. That was normal dog behavior.

And I love the description on the link, the end says "kills homeowners", not kills the dog.

The cop was responding to a silent alarm. For all he knew, there were armed invaders in the home. If she doesn't want cops on her property, she needs to get rid of that alarm.

How, or why, did the alarm get tripped?

Of the 36 times law enforcement has been called to Gloger’s address, Nocco said, nine were related to domestic incidents, nine were because an alarm went off, one was a burglary call and several involved “civil incidents.”

“If she doesn’t want us coming out there, remove the alarm system,” Nocco said. “We have video information and evidence to show we’re not hiding anything. We’re humans and very sad that this occurred. But there’s nothing (Kempink) could have done differently.

I feel bad that the dog was killed, but it's her fault.

She claims LE is told not to come on her property.
So why have the alarm?

7. The owner asked the cop to finish off the dog after the dog was wounded.

I don't understand that at all.
Potentially the dog could have been saved.

There's an old saying, "If you come by a wounded animal, kill it quickly." (a paraphrase) The idea was to quickly end the animal's suffering, and thus it was viewed as a kindness.

She demands repeatedly for the cop to shoot the dog "all the way." The dog was still moving.

If you own pets, shouldn't you have money to care for them?
She also claims police are told not to come on her property.
Then what does she have the alarm for?
