Josh Duggar's Police Records Destroyed

Source: Talking Points Memo (TPM)

Arkansas police have destroyed the records of the investigation into Josh Duggar's alleged molestation of five underage girls, a police spokesman announced Friday, a day after the reality TV star resigned his position as head of FRC Action.

Springdale Police spokesman Scott Lewis said Judge Stacey Zimmerman ordered the 2006 offense report destroyed Thursday. Zimmerman didn't return a request for comment on Friday.

"The judge ordered us yesterday to expunge that record," Lewis said, adding that similar records are typically kept indefinitely. "As far as the Springdale Police Department is concerned this report doesn't exist."

Neither Duggar nor his father, a former state representative, returned calls seeking comment Friday.

It's a fairly trivial thing to get your juvenile criminal record sealed and expunged after you become an adult, as long as it doesn't contain convictions for serious offenses. I had a couple of runins with the law when I was a teenager that became problematic when I started doing government work in my 20's. Expunging it was a matter of filing a petition, showing up to court three days later, and standing there while a judge asked me four questions and rubber stamped it. As I recall: "Have you been convicted of any crimes as an adult?" "Are there any felony charges or accusations levied against you right now?" "To what do you attribute your crimes when you were younger?" "Can you tell me what changed and why that's no longer the case?"

Knowing that this was still floating around out there, I'm a bit surprised that Duggar waited until now to have this sealed.

Which would indicate that she's the one who was only four years old in March of 2002, per the chart that Sid posted here:

You can't blame the girl for wanting to keep her identity from being drug thru the mud, since it's the neglect of her fucked-up parents that are at the root of this whole thing. I do, however, have to wonder if she was simply obeying the wishes of the patriarch of her family. Ole Jim-Bob and Michelle must be doing some heavy duty scrambling, tonight, figuring out their next move now that they've been booted off the money-train.

Dragging their brood around to that Gothard ministry has certainly proved to have a profound effect on them, one and all. I wonder if Bill Gothard was Josh Duggar's mentor?

9. Stockholm syndrome.

"Stockholm syndrome, or capture-bonding, is a psychological phenomenon in which hostages express empathy and sympathy and have positive feelings toward their captors, sometimes to the point of defending and identifying with the captors. These feelings are generally considered irrational in light of the danger or risk endured by the victims, who essentially mistake a lack of abuse from their captors for an act of kindness.[1][2] The FBI's Hostage Barricade Database System shows that roughly 8 percent of victims show evidence of Stockholm syndrome.[3]

Stockholm syndrome can be seen as a form of traumatic bonding, which does not necessarily require a hostage scenario, but which describes "strong emotional ties that develop between two persons where one person intermittently harasses, beats, threatens, abuses, or intimidates the other."[4] One commonly used hypothesis to explain the effect of Stockholm syndrome is based on Freudian theory. It suggests that the bonding is the individual's response to trauma in becoming a victim. Identifying with the aggressor is one way that the ego defends itself. When a victim believes the same values as the aggressor, they cease to be perceived as a threat."

How can the time run out to prosecute him when it involved child molestation. I wouldn't be surprised if some other girls come forward.

7. statute of limitations at the time was only three years

At the time of the 2006 investigation due to the information passed on to authorities by Harpo Productions that statute of limitations had already expired. Since then apparently the statute of limitations had been lengthened though I don't know what it is now. As I understand it, every state has it's own laws concerning statute of limitations for various crimes.

It utterly disgusts me that there are statutes of limitations on crimes against minor children in particular. A child is not in the position to be able to seek justice particularly when they are still trapped in the abusive environment. How the hell to you tell a mere child that they can't seek justice for the abuse they suffered at the age of four or five against their criminal abuser because they didn't report the crime to police before they turned seven or eight years old and were still forced to live with their abuser? It's sick and depraved. There should be no statute of limitations on any sexual crime whether the victim is a minor or not.
