KENTUCKY: Thrice-Rejected Gay Couple Sues Rowan County And Clerk Kim Davis In Federal CourtAugust 31, 2015
After being turned away for a marriage license for the third time last week, a Kentucky gay couple has sued Rowan County and clerk Kim Davis in federal court. Davis is already being sued by the ACLU. Via Lexingtons CBS affiliate:
The lawsuit was filed Aug. 25 in U.S. District Court by William Smith Jr. and James Yates, but a summons was delivered Monday to Rowan County Judge Executive Walter Blevins, who is named as a defendant with Davis and the county. Other defendants, including Davis, were expected to be served this week, attorneys have told WKYT. The lawsuit says Davis and Rowan County willfully, intentionally, and with deliberate indifference to the couples rights established a custom or policy to refuse to issue marriage licenses to individuals eligible to marry in order to deny such individuals, including Smith and Yates, their Constitutional right to marry. Smith and Yates suffered and continue to suffer irreparable damage, including but not limited to embarrassment, humiliation, loss of family security and benefits accessible by other married couples, according to the lawsuit. Smith and Yates are seeking a jury trial, a reasonable amount for compensatory and punitive damages and attorney fees. Davis has refused to issue marriage licenses, citing her Christian faith and constitutional right to religious liberty, despite a U.S. Supreme Court ruling on June 26 that legalized same-sex marriage in all 50 states. She is being sued by the ACLU because her office stopped issuing marriage licenses.
RELATED: It appears that the business day has ended in Kentucky without Davis issuing any marriage licenses, potentially opening her up to a contempt of court charge. Last week Rowan County itself charged her with official misconduct following a complaint by Yates and Smith.
Yates and Smith have been together for nine years.

Liberty Counsels Mat Staver: All Kentucky Has To Do Is Take Kim Daviss Name Off All Marriage Licenses
Providing religious conviction accommodations is not antithetical for public employees. Throughout our history the courts have accommodated peoples deeply held religious beliefs. The Supreme Courts marriage opinion does not suggest that religious accommodations cannot be made or that people have a fundamental right to receive a marriage license from a particular clerk. The stay request offers several options such as removing Daviss name from the marriage license, thus removing the personal nature of the authorization. Another accommodation would be to allow licenses to be issued by the chief executive of Rowan County or developing a statewide, online marriage license process. There is absolutely no reason that this case has gone so far without reasonable people respecting and accommodating Kim Daviss First Amendment rights.

Theres less than an hour to go in the business day in Kentucky and county clerk Kim Davis has filed yet another notice of appeal. I cant even tell what this one is really about. Below is a screen shot from Equality Case Files.

PETITION: Make Kim Davis Pay
Over 4000 have signed a Change.org petition to Kentucky Gov. Steve Beshear, demanding that county clerk Kim Davis be held personally liable for the legal costs associated with her battle against same-sex marriage. From the petition:
Kim Davis is the Rowan county, KY court clerk who continues to defy the law by refusing to issue marriage licenses to same-sex couples based on her Christian faith. She has been ordered to perform the duties of her elected position and issue the licenses by not only the Governor, but also District Judge David Bunning. Yet, she continues to defy the law. On August 26th, the U.S. 6th Circuit Court of Appeals issued a ruling, denying her appeal and telling her to do her job. Regardless, she continues to defy the courts, and now wants to take her case to the U.S. Supreme Court. Someone, most likely the taxpayers of the Commonwealth of Kentucky, will have to pay her legal fees. Its time to stand up and say no, we refuse to pay her legal fees. She should have to pay EVERY penny of her own legal bills. Its time to stand up and send her a message. Tell Governor Beshear, the KY House of Representatives, and the KY Senate, that WE refuse to pay her bill!
Davis is a public employee so it seems unlikely that she could be made to pay. Has this ever happened before?
