An enraged Waffle House customer shot and killed a waitress early Friday who asked him not to smoke.
Police said Johnny Mount was eating about 1 a.m. at the restaurant in Biloxi, Mississippi, when he lit a cigarette, reported WLOX-TV.
A waitress asked the 45-year-old Mount to put out the cigarette or smoke outside, and he began arguing with her.
Police said Mount then pulled out a 9 mm handgun he had concealed under his shirt and shot the 52-year-old waitress in the head.
She was taken to a nearby hospital but died from her wounds.

(2,978 posts)A 52-year-old waitress working in the middle of the night? Here she is doing all the right things and busting her behind and legs running around serving people, at that age, and this selfish bastard does this. Poor woman.
Kind of wish she had fired a gun at his friggin' lit cigarette instead. Goddamn I hate people who toxify my environment with their filthy, asthma, cancer-inducing second hand smoke.

(82,849 posts)Otherwise, he would have just had to go home and grouse about the smoking nazi waitress down to the Waffle House. Instead, he was able to solve the argument once and for all, and that waitress will know better next time not to hassle the paying customers.
Nope, applying "the police are always right" logic to this murderous incident still just sounds stupid, even when the murderer isn't a cop.

(24,051 posts)I don't own any guns, nor do I plan to, and I have never even held one. I do have knives in my kitchen, quite a few, and many would make suitable weapons. I cannot imagine myself ever being tempted to use one on anybody.

(36,827 posts)Everyone is subject to having the emotional side of their brain taking over the rational side. When that happens, one is far more likely to use a deadly weapon if they have one. The morons that can't seem to leave home without precious either are ignorant of this or they don't care. I'm not sure which is worse.

(16,858 posts)The one I visit is downtown. It's across the street from a couple of big casinos. People go in there to sober up all the time. We have a few Waffle Houses in Biloxi, but I'm thinking it might be that one. I hope the waitress's family is able to find peace after this.
Smoking in restaurants is still legal in Biloxi, if the restaurant wants to allow it. Waffle House changed its smoking policy fairly recently. I never thought it would come to this, not in this town, anyway. It's a very sad day.
On edit: I just read at another source that this didn't happen at the WH I visit. I didn't know the poor lady, thank God.

But proving intent will be a difficult task.

I should have used "premeditation" instead of intent. His intent was obvious but did he go to the restaurant planning on shooting somebody?
I'd rather see him locked up for life than getting off because of a technicality like planning ahead of time.
Remember, they can only charge him once. I'd rather see a charge that will definitely end up with a conviction than one that lets the perp walk.

(17,604 posts)that depending on the state, "premeditation" doesn't mean what we non-lawyers generally think it means. "Premeditation" can happen in a very short time, as part of the incident. Depends on the law of that particular state. Again, this is what has been explained to me.
I don't know any reason they would deliberately over-charge in this case.
