The Republicans will do everything within their power to block him/her. So, he should assume that they will succeed in blocking his first appointment. With that in mind, he should appoint the most liberal judge he can find in the country.

(40,416 posts)There is enough time to get a nomination through. The GOP impedes it at their peril. That is one thing the Dems will unite on. And public will not like such a flagrantly political move.
Plus, Democrats will likely have a Senate majority in January. The GOP knows that, too.
The GOP are the ones in a real pickle.

(36,827 posts)Obama's last two appointments were approved with over and just shy of a 2/3rds majority. Even most dipshit Republicans understand that blocking SCOTUS appointments has ramifications for any future Republican nominee.
