1. "Pleading the Fifth" has nothing to do with criminal arrest.

As a criminal defendant, you ALWAYS have the right to refuse to speak to arresting officers or investigators and to refuse to testify at trial. "Pleading the fifth" applies to persons subpoenaed to testify against their will.
