It's not just that those things are in the Constitution; it's that people in the US have always believed in and exercised free speech. It's not just a law; it's a tradition. So what we have that 1930s Germany didn't have are both the tradition of free speech and the advanced mechanisms for using it.

Also: After less than only a month into SCROTUS' presidency, people are already protesting in huge numbers, and those protests will only grow. The previously-supine MSM has started to notice that he's a fraud and possibly deranged. He has a 39% approval rating and that's not likely to improve. Nothing like that was happening in Germany. Yes, Agent Orange runs the executive branch, but other parts of the government, notably the courts and the intelligence services, are starting to push back.

It will be ugly for awhile but it will turn around.

4. Gallup says his approval is 39%, disapproval 55%.

This is by far the lowest approval rating for this early of any president since Truman (when they started keeping track). He is playing only to his base and not trying to appeal to anyone else, and since his base is even less than 39%, eventually he'll be in Nixon during Watergate territory (24%). His numbers will not improve. The chickenshit GOPers in Congress will stick with him only if they need the remaining deplorables in their districts to keep their seats.
