Sarah and Bristol Palin push fringe plan to let Christian conservatives rewrite the Constitution

Source: Rawstory/U.S. News

(snip)

“By calling a Convention of the States, average citizens can stop the federal spending spree, power grabs, and other abuses by proposing amendments to rein in the federal government,” Palin posted on Saturday. “After the states draft, debate, and vote upon these proposed amendments, they will then be sent to all 50 states for ratification, and three-quarters of the states must agree for any of the proposed amendments to be ratified.”
Three legislatures have already passed bills calling for a convention, and Virginia lawmakers are expected to vote on such a measure this week.

(snip)

The Constitution has been amended throughout U.S. history by Congress, but Article V guidelines set out by the founders allow revisions to be made at a convention called by at least two-thirds of state legislatures.

Those amendments would then be subject to ratification by three-fourths of the states, just as they are when passed by Congress.

She is an object lesson in how hatred makes you stupid. You don't need a constitutional amendment to curb spending, you just need a legislative budget bill that gets signed by POTUS. Duuuhhh

Four have done so, though not for Christan reasons.

Once successfully called, they would have to somehow control the the process. It isn't clear to me that only Christian' of Palin's ilk would or could be given that power. It is never been done, so I assume the state legislatures themselves would have a say on who sits on that body to rewrite te Constitution.

Once those changes have been written, amendments would need to be ratified by 3/4's of the states.

She certainly has the right to propose whatever crackpot scheme she think will convince Conservatives to write her checks which she can then spend in administrative costs but it is not likely to get done.

From my reading, there is an open question concerning whether the states could only address a single item, say gay marriage or a balanced budget, or whether they could through the whole Constitution away and start all over.

Either way, it just looks like a scheme to get people to donate money to Palin so she can spend it while pretending to do something.

in the Senate. But of course any amendments would have to be ratified by 3/4 of the states before they became part of the Constitution. The states requesting the convention could probably try to limit the convention to certain topics but it is not at all clear that the convention delegates would have to follow such limitations.

real understanding of what is in the Constitution or how it works. Something has to be pretty specific to become an amendment to the Constitution, and this (and pretty much anything she has ever said) sounds vague or a way to weaken it.
And to think that people actually voted for her to be VP. That is truly very scary.
I think the folks who wrote the Constitution were very smart in coming up with the ideas in the first amendment. It's like they saw the future!

23. If 2/3rds of the states ask for a Convention, that is ALL THAT IS NEEDED.
Mon Feb 2, 2015, 05:20 PM
Feb 2015

That it would take 34 states to call a convention is the main reason it has NOT been done since 1787. Thus it is POSSIBLE to call such a convention AND THERE WILL BE NO LIMIT TO WHAT THEY CAN PROPOSE. This is what happened in 1787, a Convention was called to "Amend" the Articles of Confederation, the members of that Convention decided to rewrite the whole thing rather then just propose amendments.

The real restriction is on HOW many states such a call for a Convention requires AND that any changes (or a new Constitution, remember what happened in 1787) would have to be ratified by 2/3rds of the state (unless one of the Changes is a reduction in the number of states, which is what happened in 1787, the Articles of Confederation requires ALL states to agree, but the then proposed US Constitution said only 2/3rds of the states needed to agree).

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress;

http://www.archives.gov/exhibits/charters/constitution_transcript.html

Here is the Article of Confederation, Article XIII, that states "alteration be agreed to in a Congress of the United States, and be afterwards confirmed by the legislatures of every State."

[T]he Articles of this Confederation shall be inviolably observed by every State, and the Union shall be perpetual; nor shall any alteration at any time hereafter be made in any of them; unless such alteration be agreed to in a Congress of the United States, and be afterwards confirmed by the legislatures of every State.

http://en.wikipedia.org/wiki/Articles_of_Confederation

Thus a convention could call for a National Referendum as the means of Ratification, if such referendum is also one of the proposed changes (or in a whole new written Constitution).

- Freedom of speech only for Teabaggers, CEOs of big corps, and right wing Christians.

- Only white property owners making more than a million a year shall have the vote.

- Women shall be considered 1/4 human and prohibited from pursuing education, careers, birth control, or speaking in public. Feminism is treason and of the devil and will result in execution. The proceedings and laws of the Salem, MA, circa 1692 shall be reinstated into law.

- 2nd Amendment: Gun ownership required for all conservative white males and the use of guns authorized on liberals, union members, teachers, feminists, community organizers, gays, anyone had received public assistance, the disabled, maimed vets demanding use of the now outlawed VA, pro-choicers, and the homeless.

- Freedom of Religion shall be recognized as long as you're Christian and of the proper
denominations.

- The research and use of renewable energy shall be punished with the death penalty.

- Any person protesting wars, environmental destruction, or police brutality shall be executed
immediately.

- any doctor performing an abortion shall be put to death with a firing squad drafted from
white, male conservatives within the court's jurisdiction.

- Sell off the national parks and open them to resource exploitation by the biggest bidder.

26. The right wing could do most of what you suggest with a GOP President and majorities in both
Mon Feb 2, 2015, 05:54 PM
Feb 2015

Lets look at your list:

- Freedom of speech only for Teabaggers, CEOs of big corps, and right wing Christians.

"Any person who wish to make a statement on the net, in print, on Television, Radio, or other means of communications including just talking to someone, MUST have a license issued by the "Department to Secure the Freedom of Speech", created under this same law. Anyone who does NOT have a license, shall be imprison for a term not less then life. Ignorance of this law is NOT a defence. Any infringement of this law shall be heard by the New Court to Secure Freedom from which no appeal may be taken.

- Only white property owners making more than a million a year shall have the vote.

This one, Congress does NOT even have to worry about the Bill of Rights, just pass a law that the only legal voters are those whose value is worth more the 1 Million Dollars.

- Women shall be considered 1/4 human and prohibited from pursuing education, careers, birth control, or speaking in public. Feminism is treason and of the devil and will result in execution. The proceedings and laws of the Salem, MA, circa 1692 shall be reinstated into law.

Why be so geneous? Declare that woman are the property of their husbands, and if not married their eldest son, if no son, their father or other male relation no matter distant. If none can be found then the court will appoint some male. As the property of someone else, such woman can NOT do anything without that man's permission, any violation is petty treason and subject to summary execution by such male or other male. Why bring up Salem, the above law will do all the Witch trials did, without the need for some sort of evidence of actual witch craft.

Some constitutional issues with such a law, but that can be worked around on the grounds that the Common Law view was a woman and man were one person and that person was the husband. That was the law in 1787 and in the late 1860s when the post Civil War Amendments were changed and those laws did not change til long after those amendments were passed, NOt because those amendments were passed.

The Militia of the US includes all males over the age of 21, approved to be members of the Militia by the "Department to Secure the Freedom of Speech", who are NOT liberals, union members, teachers, feminists, community organizers, gays, anyone had received public assistance, the disabled, maimed vets demanding use of the now outlawed VA, pro-choicers, and the homeless. Any Militiamen may use his weapon against any of those excluded from the Militia by the previous sentence.

- Freedom of Religion shall be recognized as long as you're Christian and of the proper
denominations.

"Freedom of Religion is reserved to those religions licensed by the Department to Secure Freedom of Speech. " Then pack that Department with people whose definition of religion is what they believe in and anyone else is a radical out to destroy the US.

- The research and use of renewable energy shall be punished with the death penalty.

Can be passed by a simple majority today, the US Supreme Court MAY strike it down as excessive, but if the Congress makes findings that renewable energy is a plot by Al Qaeda, that may satisfy the Supreme Court,

- Any person protesting wars, environmental destruction, or police brutality shall be executed
immediately.

- any doctor performing an abortion shall be put to death with a firing squad drafted from
white, male conservatives within the court's jurisdiction.

Why be so specific? just say execution without the right to appeal.

- Sell off the national parks and open them to resource exploitation by the biggest bidder.

Congress can do that now, they do NOT need an amendment to sell off the National Parks.

Just a comment, that the changes you "propose" do NOT need a constitutional amendment to become law, a simple majority will do along with a minority opposition that does not really oppose these changes. Please note what I mean by minority opposition is NOT people outside of congress but Congress persons themselves. i.e Democrats who do NOT do all that they can to stop such laws from being passed.
