Ruling Expected from Federal Judge on Same-Sex Marriage Ban in Nebraska

OMAHA, Neb. A federal judge is expected to make a decision this week on the ban against same-sex marriage in Nebraska. The decision was expected to come Thursday February 19th, but U.S. District Judge Joseph Batallion delayed his ruling. He is requesting by the end of the day Monday for more information from both sides.
The American Civil Liberties Union of Nebraska is representing seven couples fighting to allow same-sex couples to get married in Nebraska. Nebraska Attorney General Doug Peterson says he will appeal any decision that overturns the voter approved ban on same-sex marriage.
At a court hearing on Thursday February 19th, the couples brought up concerns to Judge Batallion about what would happen in the case of one partner passing away and their adopted child is being hospitalized, leaving the other parent with no legal rights. This is just one reason why the ACLU of Nebraska is asking Judge Batallion to block enforcement of the ban immediately.
"We are patiently waiting and we believe that the facts of the law will see the urgency of our clients situation," said Susan Koenig, Co-Council for the plaintiffs.
