Alabama Chief Justice Roy Moore said the state supreme court today issued an order that effectively keeps probate judges from issuing marriage licenses to same-sex couples for 25 days. ... That's the interpretation of Moore, who recused himself.
Moore said his view of the order is that the U.S. Supreme Court ruling on Friday ending the gay marriage order is stalled in Alabama.
Seven of the nine justices concurred with the order. Only Moore and Supreme Court Justice Greg Shaw joined Moore did not sign on.
"I am not real clear what it's saying .. it's very unclear," Jefferson County Probate Judge Sherri Friday said. At this moment, they are still issuing licenses to same-sex couples as her attorneys review the order. ... Part of the order, Friday said, states parts of the U.S. Supreme Court ruling that were appealable for rehearing.

(51,511 posts)Right now on the ED Show they are doing one of their usually lopsided polls, but today, the question is whether you agree with Donald Trump's position on immigration (that Mexican immigrants are rapists and we should force Mexican to pay for a fence). Usually the responses come back 90% or more in favor of the progressive position. But today, only 60% of Ed's audience disagrees with Trump...40% actually agree with Trump. That is Ed's progressive audience! It would hit 100% at Fox.
This is why we have the Bill of Rights, the equal protection clause in particular. It prevents the majority from taking away the rights of a minority.
Don't like the Bill of Rights? Don't be a judge! (I'm talking to you, Roy Moore).

(4,459 posts)He is now saying probate judges are not required to issue same-sex marriage licenses for 25 days. However, U.S. District Court Judge (Ginny) Granade ordered probate judges on Friday to begin issuing licenses immediately...most of them have been issuing licenses since February.

At first today, Alabama Chief Justice Roy Moore said a state supreme court order effectively kept probate judges from issuing marriage licenses to same-sex couples for 25 days. ... Moore, however, later backtracked.
"What the order means is that within that 25-day period no (probate judge) has to issue a marriage license to a same sex couple," Moore said.
Moore said that if he implied that the order prohibited the issuing of marriage license to same-sex couples then he misspoke. ... Moore said in his view the U.S. Supreme Court ruling on Friday ending states' gay marriage bans is now stalled in Alabama.
Parties have 25 days in which to contest the U.S. Supreme Court ruling before it becomes a mandate.
