Adele might not like it, but Donald Trump can use her music

By MARK KENNEDY

NEW YORK (AP) — While waiting for Donald Trump to take the stage this week at a campaign rally in Exeter, New Hampshire, fans listened to a few hit songs by Adele, "Skyfall" and "Rolling in the Deep."

That has apparently hit all the wrong notes with the British superstar: She has said she'd like Trump to quit playing her songs at political rallies.

"Adele has not given permission for her music to be used for any political campaigning," said Benny Tarantini, an Adele spokesman.

But mega-best-selling Adele may not be able to stop The Donald here.

4. Yeah, this seems consistent with how I understand BMI/ASCAP performance licenses to work.

(IANAL, but I have dealt with BMI/ASCAP licensing issues in my old job)

Still, it's a dickish thing to do, and it's encouraging that they are considering amending the licenses to allow songwriters and performers to opt out of certain uses of their material.

"It seems to me that there should be an opt-out ability where an artist — coming into an election cycle — who does not want BMI to license her music for any political campaign, should have that right," he said."

It is built into any contract a musician signs with a recording company. But this should fall under some kind of protection with association to the user of the music. So a KKK rally could use any of those "10 million musical works" for a small fee? There should be some protections against this. It is almost as powerful as having that said musician play live for the politician. People just assume that that musician endorses the politician.
