Scalia's Death Prompts Dow to Settle Suits for $835 Million

Dow, the largest U.S. chemical maker by sales, said Friday the accord will resolve its challenges to a $1.06 billion award to purchasers of compounds for urethanes, chemicals used to make foam upholstery for furniture and plastic walls in refrigerators.
The Midland, Michigan-based company disputed a jurys finding it had conspired with four other chemical makers to fix urethane prices and asked the Supreme Court to take the class-action case on appeal. Scalia, one of the courts most conservative members, had voted to scale back the reach of such group suits.
Growing political uncertainties due to recent events with the Supreme Court and increased likelihood for unfavorable outcomes for business involved in class-action suits have changed Dows risk assessment of the situation, the company said in an e-mailed statement.

(2,493 posts)Or apparently a "gun nut," I doubt this changes anything with respect to the right to keep and bear arms. Let's assume that the Supreme Court decides to reverse Heller (most people who actually pay attention to Supreme Court rulings believe this is unlikely), what do you think that changes? Many, if not most, state constitutions protect the right to keep and bear arms, and Congress isn't going to do anything meaningful on firearms in the foreseeable future. Heller could go away right now and I'd still have the right to keep and bear arms here in Virginia.

(1,254 posts)No longer a sure thing. Even with Scalia, the court favored on the side of ACA twice and gay marriage. A tie is not guarantee there will be a tie in every case. IF ANYTHING, there will be more incentive on both sides to reach a consensus on cases and settle them OR merely send them back to the lower court decision.

(928 posts)Bernie must be the nominee and not Hillary. Hillary will, IF elected, nominate corporate friendly justices and then it's back to the same ol' same ol'. She's already dog whistled to the right she's open to restrictions to Roe v Wade.
But no, President Obama should not wait, he should move ahead and we push like hell for Congress to act.

(45,806 posts)SCOTUS? Many of the cases before the court NOW are going to resort to the lower case decision because of 4-4 decisions. Cases that the Pubs were really excited to win, but now will; not. This is going to go on for more than a year before the new Prez gets to nominate someone, snd then there's the real possibility of the new Prez being a Dem! HAH! I love seeing them crying in there beer!
