LAKE MARY, Fla - Lake Mary Police are now questioning the validity of several statements Shellie Zimmerman made when she told 911 dispatchers her estranged husband, George Zimmerman, threatened her and her father at gunpoint Monday afternoon.

"We did not find a gun, did not locate a weapon," said Zach Hudson, public information officer with the Lake Mary Police Department. "Nobody ever saw a gun. A gun is not part of this story."

His attorney said he HAD a gun with him.

His truck was never searched and he was taken in custody. So the only place the gun could've been was in his truck.

Both the Lake Mary Florida Police Chief, Steve Bracknell, and the department’s spokesman Zach Hudson confirmed to ThinkProgress that George Zimmerman told officers at the scene that he did not have a gun on him during the incident. This directly contradicts what ZImmerman’s lawyer, Mark O’Mara, told CNN:
O’MARA: He acted appropriately. He never took the weapon out. The only thing he really did, which is what he told the police, was on the outside of his shirt, he made sure the gun wasn’t moving anywhere and didn’t do anything because [Zimmerman's father-in-law] Mr. Dean was sort of coming at him, that can sort of be seen in the video.
COOPER: So he had the gun actually on his person not like, in the glove box of his car?
O’MARA: That’s correct.
Bracknell acknowledged the contradiction, telling ThinkProgress “Who is telling the truth? Good question.” He added that O’Mara was “on scene providing legal advice to hid [sic] client.” Bracknell appeared to suggest that O’Mara was well-informed of the facts of the case and had little reason to invent facts — like Zimmerman having a gun — that would be damaging to his client.

Not searching the car?? I don't know what the law is, but it seems they would have the right to do so. That they didn't says they did not want to know. This sounds like typical cops who don't want to fully investigate a domestic disturbance. That seems like a failure of duty, especially if George had stayed or returned and shot someone.

And the phantom gun. Sounds like she too has been too involved in police training. But that doesn't mean that Zimmerman didn't try to spook her by putting his hand to his waistband, anticipating how she would react. This was obviously a he said/she said event from the start. And the fight over splitting the pots and pans is not about the pots and pans but a fight over control of the situation and goading her into calling 911 could well have been his plan to have her put in a bad light.

And police deception may be an issue. Mark O'Mara is now confirming that George Zimmerman was armed when he was at the house. Not only that but that he placed his hand on the gun to adjust its position so no phantom gun but a real one -- if this report is any more accurate than any of the other stories. Police are now conceding that he could have put the weapon back in his truck because they did not have a warrant to search the truck. Lastly, I am not sure why O'Mara would come forward with this information. Accordingly, I don't put that much stock in any of the stories being reported. Not this one and not the one linked in the top post. At least this agrees with my "spook her" speculation.

If the altercation took place outside of the truck, on the grounds or in the house, the police do not have probable cause to search the vehicle, absent a stated connection to the vehicle. But nothing prevents the cops from asking to search. If they didn't, I would say that's deliberate malfeasance on the part of the cops.
