NEW YORK (AP) - A motorcyclist has been arraigned on assault and other charges in connection with the beating of a New York City man by a gang of angry bikers.
Robert Sims was arraigned Saturday in Manhattan on charges of first-degree gang assault, first-degree assault and third-degree criminal possession of a weapon.
Bail was set at $100,000. An attorney for the 35-year-old Sims did not immediately return a call for comment. There was no listed telephone number for Sims at the address where police said he lived.
A criminal complaint says Sims identified himself to police as one of the bikers depicted in a photograph of the incident wearing a grey backpack and motorcycle helmet emblazoned with the number 78.

This undated photo provided by his family's attorney on Friday, Oct. 4, 2013 shows Edwin Mieses Jr. after he was struck by an SUV during a motorcycle rally in New York that turned violent on Sunday, Sept. 29, 2013. He suffered a broken spine, fractured ribs, a punctured lung and a torn aortic valve, his defense attorney, Gloria Allred, said Friday. His injuries may have left him paralyzed. I mean really. REALLY?
So, they picked up silver helmet dude and grey backpack dude.
And, Gloria Allred (sp?) is talking to Meize's family.
Good Grief. And, still no word from the glorious mayor, AFAIK.

(23,973 posts)in the first contact where the biker purposely braked in front of the SUV. His tire got bumped, they already know no one was knocked over.
There was no one on the ground to 'help'.
There were other bikers stopped to box in and scream at the driver, though. Mieses was one of them.

(68,644 posts)If we think in terms of relativity, both vehicles were moving though space at pretty much the same speed.
Cruz deliberately moved to his left into the middle lane, and then decelerated taking the rear of his bike into the front of the SUV.
He literally drove his bike into the SUV.
Other accounts that tell of the SUV ramming or driving into the bike are false in every way.

(28,955 posts)getting run over. Mieses's family should be after Cruz and NOT the SUV driver, period!

(3,829 posts)Cruz just happened to be the one that played that role. Since he didn't go down and since the group as a whole had already forced the SUV to travel at an extremely slow pace, Cruz couldn't be much more responsible than any other rider that participated in the ride.
The riders had a sense of entitlement to behave that way since the police seemed to do little to stop them. The public are just intruders into the motorcycle riders' world. The riders own that town's roads.

(5,466 posts)I would feel sorry for anyone facing those injuries but when you are part of a mob you have to face the consequences of the entire group's actions.

(89,259 posts)About a half-dozen bikers accused of beating an SUV driver last weekend used their helmets to attack him and kicked his head and body as he lay on the ground , New York police said.
Police said one of the bikers -- Robert Sims -- also stomped on the driver's head and body, according to a detective's criminal complaint.
Sims was one of two bikers who turned himself in to authorities on Friday. He has been charged with attempted assault, gang assault and criminal possession of a weapon.
