Holder seeks Fast and Furious appeal

Attorney General Eric Holder has moved to appeal a judge's ruling allowing the House of Representatives to continue with a contempt case stemming from his refusal to turn over documents related to the Justice Department's response to the Operation Fast and Furious gunwalking controversy.

In a motion filed Friday night, the Justice Department asked U.S. District Court Judge Amy Berman Jackson to allow it to take an appeal now in the lawsuit stemming from President Barack Obama's decision to invoke executive privilege and the House's subsequent votes last year holding Holder in contempt.

The Obama administration urged Jackson to throw out the case on the grounds that the courts could not or should not resolve such disputes between the executive and legislative branches. But in a September ruling, the judge—an Obama appointee—rejected that position.

The new motion (posted here) asks Jackson to allow the U.S. Court of Appeals for the D.C. Circuit to weigh in on that question before the case continues.

Operation Wide Receiver was discontinued a few months into the Obama administration and F&F started shortly thereafter.

Different programs. Details matter.

F&F was *similar* to the Bush II program. It ran from 10/09 until early '11. A bit over a year.


The easy out is to blame the appointees but that way there be dragons.

Why TF did Holder ever support it?
As disgusted as I am with the acts of the Bush Administration, I'm appalled at this administration's willingness to go along with policies that were wholly and completely against what they'd promised.

Screw Holder for not chasing bankers and concentrating on punishing marijuana crimes (maybe I ought to put 'crimes' in quotes). If he gets his ass kicked I won't be sad. In fact, and I know this sounds bitter, I look forward to it. I think he's been a sorry excuse for a reversal of what went wrong in the preceding 8 years.

Bush era, guns had radio transmitters

Obama era, no radio transmitters,
the gun's serial numbers were recorded when the guns
were picked up after shootouts

I can't believe that people are still regurgitating this nonsense.

The only thing that the Obama administration is guilty of is their usual mistake: buckling under pressure and agreeing with the Republicans.

it was started months into the Obama Admin., the one during the Bush years was called Operation Wide Receiver.

But isn't part of the judicial's job to settle disputes between the executive and legislative branches?
