Citing states rights, Senator Ted Cruz (R-TX) has introduced an anti-gay marriage bill, asking Congress to amend U.S. law with regard to the definition of marriage and spouse.
According to The Huffington Post, the Texas Republican introduced the bill on Wednesday asking the Senate to amend U.S. law with regard to the definition of marriage and spouse for Federal purposes and to ensure respect for State regulation of marriage.
Stating that he supports traditional marriage, Cruz said The Obama Administration should not be trying to force gay marriage on all 50 states. We should respect the states, and the definition of marriage should be left to democratically elected legislatures, not dictated from Washington. This bill will safeguard the ability of states to preserve traditional marriage for its residents.
In a statement accompanying the bill, Cruz and the bills only co-sponsor, Sen. Mike Lee (R-Utah), claimed their bill will ensure the federal government gives the same deference to the 33 states that define marriage as the union between one man and one woman as it does to the 17 states that have chosen to recognize same-sex unions.

What the Executive Branch is saying is that, pursuant to the Full Faith and Credit Clause of the Constitution, a marriage recognized in the state in which it was performed, must be recognized as "valid" for purposes of any federal law or benefit whether the marriage be heterosexual or homosexual.
There must be a legal point I am missing because I have often thought this whole issue would be put to bed with the recognition that a same gender marriage performed in say Massachusetts must be recognized in my (not home) state of Georgia under the FF&CC which states "Full faith and credit shall be given in each state to the public acts, records, and judicial proceedings of every other state."
It doesn't allow one state to decide if it wants to recognize a marriage or a contract or a divorce performed in another state simply on the basis of sexual orientation.
But for poor Mr. Cruz who is so stupid as to make a box of rocks look like Rhoades Scholars, his bill will (1) Never pass and (2) Does nothing to achieve its stated purpose.
Traditional marriage is not threatened by same-gender marriages. Traditional marriages are typically victims of infidelity and financial difficulties.
I don't see how keeping two men or women from marrying will prevent a husband or a wife from having an affair or help them avoid financial difficulties.
He should consider the causes of stress in marriages - unemployment or underemployment, no living wages, no access to affordable health care, inability to make ends meet, no "family support" for child care and, increasingly, elder care. Lack of maternity and paternity leave, etc.
Discriminating against same gender couples will not protect or preserve traditional marriage. Heterosexuals are doing a bang-up job of destroying the institution themselves.

(11,519 posts)ANY time a politician, especially one of the R persuasion, talks about "states rights" I already know that it's about discriminating against one of the minority populations in this country. (I've had the secret decoder ring for quite some time now!!!!)

(18,672 posts)The right wing's wording (and thinking) is seriously messed up. Heteros can still marry as they please. No one who is not gay is being forced into homosexual marriage. Whether or not gays want to marry should be their business. You don't see gays sticking their noses into straight marriage and straights maybe should focus on their own crumbling marriages. I don't believe in marriage, but you don't see me campaigning to stop it, or even opening my mouth about it to anyone (except here, to make a point). They don't have to like gay marriage, but they do have to recognize civil rights in this country. If that is too difficult, instead of trying to take the US back into the f*cking stone age, they might consider relocating to the many countries that are still in line with their archaic and inhumane views on human rights.

you don't have to marry another man or even have sex w/him but the equal
protection clause of the 14th amendment is written so that sooner of later gay
marriage will be the law of the land.

(14,337 posts)You live in a state that allows gay marriage and move to one which bans it. You need a driver's license in the new state. They want to see your old license, BC, and Marriage License. Clerk has to carefully check out that ML to see if you are married to a member of the opposite sex. Same sex marriage? Clerk will not give you a driver's license with your married name. This is already happening in Florida.
I recently had to renew my Driver's License. I married to a man 40 years ago in NY, but since NY recognizes gay marriage, I knew that clerk would be checking names for gender. Screw you, you are NOT getting my ML. If you won't recognize ALL NY marriages, I will not show you mine. I gave them my Passport instead. None of your business WHO I am married to. TRY not taking a Federal document for ID.
This is just a very MINOR problem that is happening right now. Others issues are far worse. My daughter had to have emergency surgery. Fortunately, she is in NY where her wife can be at her side and if something happened, can make medical decisions for her. If she and her wife were here in Florida? They would be considered TOTAL STRANGERS. They need to see an attorney and have legal documents drawn up for Health Proxy and POA if they travel to a state that won't recognize their marriage? That is absurd, and insulting.
Do these stupid, bigoted congress critters understand any of these repercussions? They don't care.
