BART cited, fined $210,000 for worker deaths

State regulators on Thursday cited BART for three willful, serious violations and fined the transit agency $210,000 for the deaths of two workers hit by a train in October while working on a section of track in Walnut Creek.

Cal-OSHA determined that workers Christopher Sheppard and Laurence Daniels did not meet qualifications to perform work near energized third rails.

State investigators also found the "high-ranking transportation manager," who was training another employee to operate the train, was seated in the passenger car and could not view the track from his position.

The third violation involved the controversial "simple approval," a policy that allowed trackside access for workers who had to rely on themselves for safety. State regulators said the protocol was "inadequate" and "not followed."

There should be multiple million dollar payouts to them. They are the ones truly suffering from this loss.

Actually, BART more than likely has quietly paid the families a handsome sum. There have been no talks of wrongful death suits at all.
