NEW YORK (AP) — A New York City police officer involved in the arrest of a man who died in custody after being placed in an apparent chokehold has been stripped of his gun and badge and placed on desk duty, police said Saturday.

Officer Daniel Pantaleo, an eight-year NYPD veteran, and an officer who has been with the force for four years were both taken off the street after the death Thursday of 43-year-old Eric Garner on Staten Island, police said.

The department would not identify the second officer but said he would retain his gun and badge while on desk duty. The reassignment is effective immediately and will remain in effect while Garner's death is being investigated, police said.

Partial video of the encounter obtained by the New York Daily News shows the 6-foot-3, 350-pound Garner becoming irate and refusing to be handcuffed as officers tried to arrest him on suspicion of selling untaxed, loose cigarettes on a sidewalk.

Officer Pantaleo has been sued by three different people over the last two years:

According to federal court records, three men have sued Pantaleo within the last two years over what they argued were unlawful, racially motivated arrests on Staten Island.

And this is what the PBA's president had to say:


The president of the Patrolmen's Benevolent Association, the city's largest police union, called Pantaleo's reassignment a "completely unwarranted, knee-jerk reaction."

The decision, Patrick Lynch said in a statement, "effectively pre-judges" the case and denies Pantaleo the "very benefit of a doubt that has long been part of the social contract that allows police officers to face the risks of this difficult and complex job."


Hey, PBA President, HE FUCKING KILLED ANOTHER PERSON BY USING A TECHNIQUE THAT IS NOT APPROVED.

If I made an illegal turn, hit and killed some one, I'd be under arrest.

This just really burns me up.

dollars, selling loose cigarettes that couldn't be taxed, while being black on the sidewalk, got accosted by these jerks in blue, got pissed because this was stupid harassment/abuse of police powers, started arguing/became "irate", shouldn't have because the all powerful police officer/master was in his face for a 'crime' with NO victims and was choked to death because of it. All for selling loose cancer sticks, untaxed while black. Ain't america great? Not to mention this 'crime' he died for, as being an affront to capitalism because there were no taxes involved..... Oh I'll wait for it from some on here. "But, but he was breaking the law and shouldn't have become irate with the police". He died because he was not respectful/nice enough to the police/masters. Could this guy not have been able to find a job, lost a job, had kids to feed, had to feed himself and figured something as innocuous as selling loose cigarettes, untaxed, was a good way to get some change? And he died for that? And for being a 350 pound black man threat to the powers of these police/masters I forgot to add. I'm irate.

They are sold on the street at twice the price of the full pack. Cigarettes, as is milk, are gateway drugs to marijuana, then ultimately, crack cocaine. There are very few addicts who have not graduated from milk to cigarettes, then to crack.

Loosies and milk are a menace to society.

That is why, selling loosies is a capital crime.
