Obamacare tax credit ruling could affect up to 500,000 Michiganders

Schuette was one of several state attorneys general to file briefs arguing that the IRS was violating the Tenth Amendment by allowing the credits for everyone, even in states where legislatures declined to set up their own exchanges.
"The IRS rule would deprive states of the economic benefit of their decision not to establish state exchanges. Notwithstanding the IRS unlawful efforts to amend the statute by regulatory fiat, the plain language of the ACA authorizes states to choose not to establish state exchanges," Schuette's brief argued.
The tax credits amount to $4,700 per enrollee, according to the Congressional Budget Office, and figures produced by the Center for Healthcare Research and Transformation at the University of Michigan estimate that more than 492,000 people are eligible for the credits.
"Once again, Michigan families are being hurt by Obamacare. Theyve faced higher premiums, losing their healthcare plan, theyre not able to choose their doctor, and now this. Congress should repair this train wreck and get the IRS out of our health care system," Schuette spokesman Joy Yearout said.

Michigan Attorney General Schuette (R-of course) complains that the ACA causes insurance premiums to increase and he supports eliminating the ACA premium tax credit which of course would reduce premiums.

(34 posts)First of all it was known weeks ago that this decision would go this way. It was also known that the FULL court of appeals would hear the decision and that the rest of the judges are Democrats and at least two are Obama appointees. So this decision will be reversed.

(34 posts)...stating that Obamacare could be in for a legal setback but then explaining that the full appeals court would hear the appeal later and likely reverse it.
It is really sad to see this development. It reminds me in some ways of the ways the 14th and 15th amendments were rolled back and blacks suffered from Jim Crow. We are the only developed nation without healthcare for all of our citizens. There is a core group of rich demagogues that wants time to go backwards and it is damaging this country in terrible ways. That said, I think the subsidies will be upheld.

There are several pending challenges, but I don't recall this one as being one of the ones that was ruled on today.
