Governor (NE) hopeful Mark Elworth Jr. files petition to keep Heidemann on ballot

LINCOLN — Mark Elworth Jr., Libertarian candidate for governor, filed a District Court petition Friday seeking to require Secretary of State John Gale to certify Lavon Heidemann as the Republican candidate for lieutenant governor.

“For me the issue is not about whose name appears on the ballot,” Elworth said. “The issue for me is that the rule of law governing this state.”

Heidemann resigned as lieutenant governor on Tuesday and withdrew as a candidate to be Republican Pete Ricketts' running mate in the governor’s race. Ricketts then named Mike Foley as his choice to be his lieutenant governor.

State law states that Ricketts had until Sept. 1 to name his running mate.

Democrat Chuck Hassebrook, who argued that Ricketts should not get to make the change, has said he had no plans to challenge Gale’s decision.
