Otter says state should comply with gay-marriage order when it comes again

Source: Idaho Statesman

he U.S. Supreme Court withdrew Justice Kennedy’s Wednesday stay about 3 p.m. Friday. Several hours later, Gov. Butch Otter, who had asked Kennedy for the stay, signalled he was ending his fight to preserve Idaho’s gay-marriage ban.

...snip...

“The Supreme Court’s order lifting Justice Kennedy’s stay effectively allows same-sex marriage in Idaho as soon as the 9th Circuit directs compliance with its decision,” Otter said in a statement. “I disagree with the court’s conclusion, which negates the 2006 vote of the people of Idaho, is contrary to the values of most Idahoans, and undermines fundamental states’ rights. But we are a nation of laws. Idaho now should proceed with civility and in an orderly manner to comply with any forthcoming order from the 9th Circuit.”

He said he’d confer with the attorney general and legislative leaders: “In the meantime, I encourage patience and civility.” Otter and his office declined further comment.

This is a big deal. It's another clear signal from the Supreme Court that they aren't going to interfere in these circuit court decisions.

If a circuit court - perhaps the 6th? - rules against equality, then the SC may step in. Otherwise, they're staying out of this.

Let freedom ring.
