Keystone XL opponents will have a chance to be heard in South Dakota

LINCOLN — Nebraskans who have long worked to block the Keystone XL pipeline in their own state now get a chance to delay the project in South Dakota.

The South Dakota Public Utilities Commission this week agreed to allow 43 individuals or groups to intervene on the commission’s review of the pipeline route through South Dakota. About 15 are neighbors to the south who have vigorously fought the project at home.

“We have the Ogallala Aquifer in South Dakota and Nebraska. That aquifer does not know a state line,” said Art Tanderup, whose Neligh, Nebraska, farm is along the pipeline route. Tanderup was among those granted intervenor status.

A lawyer for TransCanada Corp., the company that wants to build the pipeline, argued unsuccessfully to block the applications filed by Nebraskans. The intervenor designation means the opponents can question witnesses while submitting testimony and evidence in a multi-day commission hearing that resembles a court proceeding.
