Justice orders disclosure of limited grand-jury information in Eric Garner chokehold death

STATEN ISLAND, N.Y. -- A Staten Island justice on Thursday ordered the release of limited information regarding grand-jury evidence in the Eric Garner police chokehold case.

State Supreme Court Justice Stephen J. Rooney said the material, which District Attorney Daniel Donovan sought to disclose, "has already been widely reported in the media."

The following information was revealed:
•The grand jury sat for nine weeks.
•The panel heard from 50 witnesses, 22 of whom were civilians. The remaining witnesses were police officers, emergency medical personnel and doctors
•60 exhibits were admitted into evidence, including four videos, records of NYPD policies and procedures, medical records pertaining to Garner's treatments, autopsy and on-scene photos and NYPD training records.
•The grand jury was instructed on relevant principles of the law, including the penal law regarding a police officer's use of physical force in making an arrest.

But if the physical force used is a banned procedure, then the penal law shouldn't apply, should it?

It is prohibited as a matter of NYPD policy; it is NOT prohibited as a matter of New York State or NYC law.
