Bruning files lawsuit over Colorado’s legalization of marijuana

LINCOLN — Nebraska Attorney General Jon Bruning filed a lawsuit Thursday with the U.S. Supreme Court, seeking a declaration that Colorado’s legalization of marijuana violates the U.S. Constitution.

At a press conference Thursday, Bruning said he was being joined in the case by Oklahoma Attorney General Scott Pruitt.

"Federal law undisputedly prohibits the production and sale of marijuana," Bruning said. "Colorado has undermined the United States Constitution, and I hope the U.S. Supreme Court will uphold our constitutional principles."

Some Nebraska law enforcement officers undoubtedly will welcome Thursday’s action.

for his son and he also personally doesn't like it.

Another point, he thinks marijuana is coming into his state because of Colorado's legalization? Got news for him, it's been growing and coming into Nebraska for decades.

The genie is not going back into the bottle, at some point in the future pot will be legal in all states.

could backfire, big-time. It isn't fiscally feasible nor socially popular to continue cannabis prohibition, even the GOP realizes that.....
Given the recent action to protect MMJ patients in the omnibus bill...I'd like to see their faces should they De-schedule cannabis altogether.
It's possible that it may only be rescheduled to a sched II or III..but things are changing. The courts reportedly will release their determination in Jan 2015.
OK & NE frivolous lawsuit may actually speed things up a bit regarding said re (or) descheduling

The Supremacy Clause says, "the US Constitution and the laws which may be made in pursuance thereof are the supreme law of the land." And since weed IS a Schedule I drug...

It would be pretty easy to nip this shit in the bud, no pun intended: The Colorado Attorney General needs to file a lawsuit with the Supreme Court seeking a declaration that Nebraska's abortion laws violate the U.S. Constitution.

Ya think maybe the problem is Jon Bruning really needs a trip to Colorado?

Marijuana can be regulated under interstate commerce and it is currently illegal under federal law (The Controlled Substances Act of 1970).

The lawsuit is saying Colorado must follow federal law.
