Probate Judges Association: ruling doesn't mean gay marriage legal in Alabama

MONTGOMERY, Ala. (WAAY) - The Alabama Probate Judges Association issues a clarification on a big ruling.
The association says the ruling doesn't open the door for the issuance of same sex marriage licenses.
They say Cari Searcy and Kim McKeand of Mobile, are the only plaintiffs in the lawsuit at the center of the ruling.
That is a key point in the effect of the ruling, and the duties of probate judges

For the reasons stated above, Plaintiffs motion for summary judgment (Doc.
21), is GRANTED and Defendants motion for summary judgment (Docs. 47), is
DENIED.
IT IS FURTHER ORDERED that ALA. CONST. ART. I, § 36.03 (2006) and ALA. CODE 1975 § 30-1-19 are unconstitutional because they violate they Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment.
IT IS FURTHER ORDERED that the defendant is enjoined from enforcing those laws.

(6,810 posts)Did the Alabama Super-Duper Judge Club rule on this case from a conference room, or did a judge in a court of law? Methinks the judge would know their own ruling and to whom it applies.

(4,118 posts)is optional in NM and either they marry ALL or none, as my county probate is choosing to marry none-their only ACTUAL have-to duties are probating wills and dealing with after-death duties. Is Alabama different? In NM, all clerks had to issue licenses after our court ruling. Maybe AL is different.
