Judge bans Confederate flag on future Virginia-issued license plates

A federal judge in Danville ruled Friday morning to ban the Confederate Battle flag from future Virginia-issued specialty plates.

No decision has been made on whether the almost 1,700 specialty plates currently in circulation will be recalled or determined to be invalid.

The final decision on what to do with the remaining specialty plates will be determined in Judge Jackson Kiser’s written opinion. ... The ruling dissolves his 2001 injunction that had allowed the Sons of Confederate Veterans to place the confederate battle flag on certain specialty license plates in Virginia.

Virginia Deputy Attorney General Rhodes Ritenour said in federal court Friday morning that Kiser gave “every indication” that he will grant the commonwealth of Virginia its motion to vacate the 2001 U.S. Fourth Circuit Court injunction that allows the Sons of Confederate Veterans to display their logo on specialty plates.

Why was this in federal court? Because there was a "2001 U.S. Fourth Circuit Court injunction that {allowed} the Sons of Confederate Veterans to display their logo on specialty plates." The SCV might try for an appeal, so this could keep going.

DANVILLE, Va. — A federal judge ruled Friday that Virginia can refuse to issue specialty license plates that show the Confederate flag, following a recent Supreme Court ruling that such a ban does not violate the 1st Amendment.

U.S. District Judge Jackson Kiser said he will issue a written order to address whether the nearly 1,700 Confederate license plates that have already been issued may be recalled by the state.

At a U.S. District Court hearing in Danville, state Attorney General Mark R. Herring’s office argued that a 14-year-old injunction that keeps Virginia from prohibiting the use of the flag on license plates should be vacated because the Supreme Court found that government-issued items are not protected as free speech under the U.S. Constitution.
