Idaho Supreme Court Rules Same-Sex Couples Can Both Adopt

The Idaho Supreme Court has ruled same-sex couples have the same adoption rights as heterosexual couples do.

The decision came as the result of a lawsuit brought by lesbian couple Darcy Drake Simpson and Rene Simpson, who were married in California last year after eighteen years together. The couple have two children, a son born to Rene in 1998 and a second boy Rene adopted as an infant in 2001.

Now, in a unanimous decision, the Idaho Supreme Court has reversed that lower court’s decision. The high court found that the language of the law – “any person may adopt a minor child” – clearly allows adoptions by same-sex couples.

Justice Jim Jones, writing for the court:

“In sum, the magistrate’s interpretation of Idaho law is simply not supported by the plain text of the statute. In light of the unambiguous language in I.C. 16-1501 that allows for ‘any adult person residing in and having residence in Idaho’ to adopt ‘any minor child,’ and because chapter 15 contains no provisions that limit adoption to those who are married, Idaho’s adoption statutes plainly allow Jane Doe to adopt John Doe and John Doe I.”
