Barring a stay or emergency order from the United States Supreme Court, a pair of dual rulings released Tuesday by two federal courts appear to have largely dismantled South Carolina's constitutional ban on same-sex marriage.
The 4th Circuit Court of Appeals ruled against South Carolina Attorney General Alan Wilson and denied his request for an emergency stay on a court ruling last week that ruled the state's ban on same-sex marriage was unconstitutional.
"Upon consideration of submissions relative to appellant's motion for stay pending appeal, the court denies the motion and denies the alternate request for a temporary stay," the unanimous three-judge ruling said.
The appeals court ruling means same-sex marriages in South Carolina can proceed beginning on Thursday at noon, the deadline set by U.S. District Court Judge Richard Gergel last week when he tossed out the state's ban. The 4th Circuit already ruled same-sex marriage bans unconstitutional earlier this year in other states like Maryland, Virginia, West Virginia, and North Carolina.

(14,532 posts)there I a waiting period. It goes county by county, so it is suggested that you apply a week ahead of time.
Next week is Thanksgiving weekend. I suspect a whole lotta weddings will be then. Also in SC a notary can perform a ceremony.

(45,806 posts)I used to live in SC. They're no better than the people anywhere else I've lived, but you sure can't tell THEM THAT THEY believe they are the holiest and most devout state population in the World! Church every wed, Sat & Sunday. Church socials wre their entire social life, and heaven forbid you gt caught with a beer or drink in your hand. Funny though, talk to a trash collector, and he'll tell you the "Holiest of them all" wre the houses where he collected the most beer cans and empty whiskey bottles. I think that's what bothered me the most about living there. Nobody was really honest with you.
