Proposed: The Gun Control Act of 2013

Since a lot of people greet my gun control skepticism with "what's your idea?", here it is:

Schedule semi-automatic firearms as Title II weapons (probably with a cheaper tax stamp than the current one). Simultaneously repeal the Hughes amendment and re-open the registry. (carrot, stick)

Create a "mini-FFL" license category for people who only wish to buy and not resell semi-automatic weapons or the ammunition for them (yes, this will mean no more mail order of ammo -- also, I'm being a little tricky here, since ammunition isn't magically only for a semi-auto or other action, but there are some broad generalities, e.g. I can't think of many semi-automatic .357s, or non semi-automatic 9mms, and the ATF has smart people who can write the actual schedule). Double the ATF's funding so that people will be able to get the licenses fairly quickly. Getting a license will require listing all now-Title II weapons you own in addition to the background check. Compliance here will be a weak point, but even 50% compliance could be a good thing.

Authorize ATF to create a list of offenses or other conditions that will result in the revocation of the mini FFL (specific crimes, involuntary commitment, maybe other stuff), as well as avenues for rehabilitation.

Require all transfers of Title II weapons to go through a full FFL, with a small statutory fee for the transaction. (Grandpa can still pass you down his shotgun, for instance, but not his AR 15 without a background check.)

Ban the new manufacture or import of semi-automatic weapons with detachable magazines, but grandfather in all existing ones (which will be registered when their owners apply for the license so they can buy their ammo). This probably is a poison pill, but if nothing else it's something we can give up in negotiations.

Make a pretty severe penalty for unauthorized transfers including through negligence (that is, make it a strict liability situation) and figure out some way to incent DOJ to actually enforce that.

So, that's my idea.

For the reasons previously stated by many ...

1. Using a tragedy to refloat a prohibitionist agenda based on capacities, rates of fire, muzzle velocities, or "scary-looking" criteria is a non-starter. Once the outrage has died down, the same realities on the ground are still there. Gun-control doesn't win votes.

2. The current congress won't pass any additional federal gun restrictions

3. States are trending towards LESS gun legislation, not more

and if he must use a tragedy to enact legislature then what he should PUSH THROUGH is a real Honest To Goodness HealthCare Bill.

Mental Health has been negligently defunded for the last twenty years and we are beginning to reap the sad benefits of that which we did not tender or sow.
