Just now on Rachel's show, there was a clip of said doctor saying of Hillary's doctor, "I know her physician, and I know some of her health history which is really not so good."
It is against the law for a health care provider to publically discuss any protected health information without direct consent of the patient involved.

(80,700 posts)I wonder about that, myself. Could she sue? This could well be argued as slander - it's spoken. As opposed to libel which is written. (Simplified definitions.) But then again, she's a public figure and I don't know all the dynamics involved. I was about to say I thought maybe because she's a public figure she can't sue, but I remember when Carol Burnett sued the National Enquirer and won a ton. And Gawker just went under because they were sued over a Hulk Hogan video they ran with.

(12,540 posts)such a suit if she can prove the defamation was made with malicious intent or reckless disregard for the truth. So - a higher bar than for a purely private person, but doable with an egregious incident. Of which we have many lately.

(16,356 posts)There could also be prison. Let alone civil lawsuits It's extremely serious and physicians know it. As much as I'd love someone to go after this, I worry that it would bring unwarranted attention to matters of no importance as far as HRC's health goes.

(5,417 posts)And of course, who knows if its true. Assuming the exact phrase was her health history is 'not good'. That could easily be defended. She had a blood clot in 2012. That is 'not good'. I would expect a lot of people in their 60's could have a health problem a doctor could describe as 'not good'.
If my blood pressure is 121/80, my doctor could say that its 'not good'. Sure it should be 120/80, but the doctor is entitled to his opinion that its 'not good'. In short, a slander lawsuit wouldn't go anywhere.
HIPPA, that's another story.

I also absolutely noted immediately his claim of participating in violating patient privacy. This behavior is fully as bizarre as any of the rest. It's very much against the law, and no rational physician would admit it in front of cameras. His comment would also have to breach some standard even if the gossiping never happened, which is of course the case.
Signing a letter he did not write, which would be easily enough established to the standards of an inquiry into his conduct, is probably only one of the other serious ethical violations that an investigation would identify.
As for Hillary suing, if she sued people for libeling and slandering her in national news media she'd have spent the last 25 years doing nothing else. She's probably mostly forgotten about this weird little man.
Hope she's having a nice, relaxing day and has gotten in some grandma time.

He's obviously lying about writing the Trump letter without instruction, so to think he knows about Hillary's health history is ludicrous.

(6,661 posts)Her doctor supposedly violated confidentiality by blabbing details to an acquaintance, who in turn is now repeating it, or so he says. But if he's guilty, then so is his source.

(11,617 posts)I am much more familiar with FERPA, the educational version of HIPAA. I am able to talk about confidential issues regarding a student with another University faculty member because we are all under the same restrictions. We are absolutely forbidden to talk about a student with someone outside the University, including parents, unless the student has expressly waived confidentiality in writing. Our official line was, "I can neither confirm nor deny that the individual has any connection with the University."

(7,570 posts)You can only share "the minimum necessary" to accomplish treatment, payment, or operations. Which means that you absolutely cannot shoot your mouth off about your patient to someone else who's not involved with any of the above regarding that same patient.
So, yeah, if the doctor weren't spouting complete and utter horseshit (which he is), it would plainly be a HIPAA violation.

(4,784 posts)he actually didn't say that her doctor told him anything about her at all. He says that he knows him/her. If they both practice in NYC, that would not be very surprising. He could have easily met him/her at a medical conference etc.
"I know some of her health history which is really not so good": what he *knows* may well have been gleaned solely from news reporting. We all 'know' some of her health history from that source.
I think these are classic weasel words, intended to cause someone to draw a conclusion that the words alone do not necessarily support.
A real sleaze, he is.

Tho I don't want to see more attention brought to this video clip I would hope that Hillary's physician is prepared to refute the quacks statement.

(2,067 posts)The amount of breached data from state and federal-owned health institutions and programs is unreal. Report after report has shown the government does not follow the HIPAA security and privacy standards it imposes on everyone else.
Of course they never investigate or fine themselves for these breaches. They just spend all their time going after the private providers. Unreal.
With that off my chest, Trump's doc is a douche!

I don't think it is a HIPAA violation because I don't believe for a moment that future President Clinton's doctor would do such a thing, since it seems like she is a professional with standards unlike Trump's rather... interesting gastroenterologist.
Future President Clinton... I need to start saying that more; sounds comforting amidst the nonsense.
