Cold Stone Creamery employee fired after wishing Obama dead on Facebook



A Turlock, California woman was fired from her job this week after publishing a racial slur to her Facebook account and wishing for President Barack Obama’s assassination.

The Cold Stone Creamery company said it spent much of Wednesday coping with the social media fallout from the comment, which was posted by former Cold Stone employee Denise Helms, 22.

Helms referred to Obama on her Facebook account as “the n*gger,” adding: “maybe he will get assassinated this term..!!”

“The employee is no longer w/the company,” a Twitter account for Cold Stone Creamery explained on Thursday. “We were as shocked as you were by her outrageous & completely unacceptable comments.”

Making a legitimate threat against the president is a felony crime, and all threats against the nation’s leader are investigated by the Secret Service.

I have a family member who works for a state rep. and a lot of the people who come in and complain about the state of the country are not registered to vote. Especially the really fired up ones. That could explain GOP confusion. They know these people are out there but they don't actually vote!

She's probably a dream compared to them. Too bad she has so much hate for someone because his skin isn't the same as hers. If she were paying attention, she'd know he's really trying to help her, even if she thinks little of him.

And in many states work is "at will." An employer can terminate you for "good reason, bad reason, or no reason." As long as it's not a protected reason like race.

On related front (with respect to Constitutional protection not applying to private companies) ... I present the following scenario:

Your employer, ABC Corporation, suggests that you are misappropriating and sellling proprietary goods. In their investigation, they dispatch their corporate security agents to your home. You happen to be away from home, at the time; so they break-in (or enter through an unlocked window) and conduct a thorough search of your premises. But in the process, they kill your watch turtle, destroy the match-stick castle that you spent the past 3 years assembling and leave all of your faucets on, causing your bathroom to flood. Not finding any company owned contraband, they leave.

The following day, you are called to your boss' office, presented with your personal dairy that you kept next to your bed. Your boss directs to to open the diary to pages 2-412, which you know detail in very descriptive terms, every liaison your have had with his trophy wife and adorable 21 year old daughter (including those time you enjoyed them at the same time, in between them enjoying each other). You are summarily fired.

Question: What, if any, recourse do you have? And, if you do have recourse, against whom?

Answer: Press charges for criminal and civil trespass and, possibly, criminal damage, against the person(s) that broke into your home, assuming that you can identify who they were. And possession of stolen property against your boss.

But the corporation would have no civil or criminal liability related to the break-in, unless you can prove that the person(s) that committed the break-in was/were directed to do so, by a corporate actor, acting within their corporate role. Lottsa luck accomplishing that! You have no 4th Amendment rights here.

And, you are still out of a job, as you are at-will and have no 4th amendment (fruit of a poisonous tree) protection and no 5th amendment (due process) rights.

Ain't working in the private sector grand?

I hope the schooling system takes two minutes to remind students that while you have the right of free speech, calling for the assassination of the President of the United States can land you in jail.

Maybe they leave that part out in HS Civics or maybe she wasn't in class that day.

Threatening the President of the United States is a class D felony under United States Code Title 18, Section 871

Is a protected right as part of our Constitution.

What most don't realize tho is that freedom also comes with the RESPONSIBILITY to use it properly

I hope being unemployed is her friend for at least a decade.... after she gets out of jail
