Obama nominating 3 to US appeals court
WASHINGTON (AP) -- A White House official says President Barack Obama plans to name three nominees Tuesday to the influential federal appeals court in Washington.
Obama's nomination of Patricia Ann Millett, Cornelia Pillard and Robert Leon Wilkins is sure to set up a battle with Senate Republicans who say the court doesn't need more judges. Republicans have proposed legislation to transfer two of the D.C. circuit's vacancies to other parts of the country with higher case loads. The GOP legislation would eliminate the third vacancy on the appeals court.
A White House official said Monday that Obama planned to announce all three nominees in the Rose Garden on Tuesday. The official wasn't authorized to discuss the nominees publicly before the announcement and spoke on the condition of anonymity.

He seems to be one of the few on the left who can, and is will to, play at Robert's level intellectually. I think the right knows is an explains why they're terrified of him.

Or if we can end up with 60+ democrats in the senate in 2014.

On February 24, 2010, President Barack Obama nominated Liu to fill a vacancy on the U.S. Court of Appeals for the Ninth Circuit. For more than a year, Liu's nomination languished, amid significant opposition from Republicans in the U.S. Senate. On May 19, 2011, the Senate rejected cloture on Liu's nomination in a 52-43 vote, and on May 25, 2011, Liu informed President Obama that he was withdrawing his name from consideration to the seat on the Ninth Circuit, telling the president that "With no possibility of an up-or-down vote on the horizon, my family and I have decided that it is time for us to regain the ability to make plans for the future."
On July 26, 2011, Governor Jerry Brown nominated Liu to a seat on the Supreme Court of California, succeeding Associate Justice Carlos R. Moreno. Three days later, President Obama formally notified the Senate that he was withdrawing Liu's nomination for the federal 9th Circuit. He was sworn into the California Supreme Court on September 1, 2011

Grassley (R-IA) of the Judiciary Committee, as mentioned above and below, is looking to reshape the courts, though obviously his legislation has no chance of moving at present. It's all the more motivation to ensure the Democrats keep control of the Senate.

White House Names Three Nominees To D.C. Circuit Court
President Obama will announce three nominees to fill vacancies on the D.C. Circuit Court of Appeals on Tuesday morning, a White House official confirmed to TPM.
The nominees will be attorney Patricia Ann Millett, Georgetown law professor Cornelia Pillard and U.S. District Court Judge Robert Leon Wilkins.
Tomorrow, at 10:15 AM in the Rose Garden, the President will announce his intent to nominate three candidates for the United States Court of Appeals for the District of Columbia Circuit, the White House official said. Patricia Ann Millet, who has served in Administrations of both parties; Cornelia Pillard who served as former Deputy Assistant Attorney General and former Assistant to the Solicitor General; and Judge Robert Wilkins, who was confirmed unanimously for the D.C. District Court in 2010.

Note regarding the First Circuit:
Judge Michael Boudin took senior status on June 1, 2013 leaving one seat vacant - thus leaving the Democrats with the majority of active judicial seats on the First Circuit.
Note:
The numbers up above do not include the semi-retired judges that continue to serve on senior status and hear cases from time to time.
Regarding only the senior status judges: 11 of the circuits have a Republican majority and 2 of the circuits have a Democratic majority.
