As McDonald struggled to breathe, Van Dyke prepared to reload his weapon – but at the urging of his partner, who was not identified, he did not fire after reloading the 9-mm semiautomatic, according to the documents. Van Dyke’s partner kicked the knife away. The knife recovered by police had a 3-inch blade that folded into the handle.
