They know what they've done.

In all likelihood, Bush will issue preemptive pardons (gosh, who else did that) just before leaving office (another reason he needs to be impeached NOW) preventing any further prosecutions. Their goal is to run out the clock till that happens.

Although I continue to believe in the absolute pardon power, I now concede that pre-emptive pardons need to be outlawed and that requires constitutional amendment.
