here's a link for you http://www.shusterman.com/marriage.html one of the limitations is that if the non resident has been in the country unlawfully for more then 180 days. I'm not sure what happens if that is the case but i would imagine that it means they must return to their country of origin before apply. My daughter is getting married to a non resident. I am familiar with the process but not fully versed. One of his concerns is that he may have to return to his home country before obtaining residency. Again though i would ask, was the gentleman involved suffering at the hands of his government?
