but many law thresholds are arbitrary

look at age of consent. i used to live in a state where it was 14. in others, 16. in some 18.

is that arbitrary? sure. but the law has to draw arbitrary laws at times.

regardless, the .08 level IS based upon a hell of a lot of peer reviewed studies. feel free to review the data from NHTSA. the issue isn't whether you FEEL impaired. it's wheter you are.

impaired is NOT 'drunk'. it's a lesser standard.

for example, a very fatigued person is EASILY the functional equivalent of your average .10.

regardless, the law is somewhat arbitrary, but it's a bright line distinction, AND it doesn't impose upon any right, fundamental or otherwise. there is no RIGHT to be a .08 and drive.

so, it's perfectly fair imo.

fwiw, the highest dui i ever arrested was over .45

now THAT is drunk
