September 7, 2011 — President Obama appointed Philip Zelikow, associate dean for graduate academic programs in the University of Virginia's Graduate School of Arts & Sciences, to serve on the President's Intelligence Advisory Board, the White House announced Tuesday.

Zelikow, White Burkett Miller Professor of History, will remain with the University while serving on the board, which serves as an independent source of advice to the president on the intelligence community's effectiveness in meeting the nation's intelligence needs, and on the vigor and insight with which the community plans for the future.

"Philip is a valued colleague, exceptional scholar and highly skilled administrator with a distinguished record of service in government and academia," said Meredith Jung-En Woo, dean of the College and Graduate School of Arts & Sciences. "This appointment reflects his and the University's longstanding commitment to education and public service. In 1998, Philip Zelikow published an article in Foreign Affairs, the journal of the Council on
Foreign Relations, entitled CATASTROPHIC TERRORISM: Imagining the Transformative Event.
Nearly two years later, PNAC picked up the CFR-Zelikow language, saying that the desired
transformation "is likely to be a long one, absent some catastrophic and catalyzing event --
like a new Pearl Harbor..."

'"It was very explicit," Mr. Clarke said of the warning given to the Bush administration officials. "Rice was briefed, and Hadley was briefed, and Zelikow sat in." Mr. Clarke served as Mr. Bush's counterterrorism chief in the early months of the administration, but after Sept. 11 was given a more limited portfolio as the president's cyberterrorism adviser. Now we know about Rice and Hadley, her deputy. But how about Zelikow? He's a former NSC official from the first Bush administration and a close associate of Rice's. The two of them even wrote a book together. He was in the key meetings where the warnings -- seemingly ignored -- about al Qaida came up. He seems like someone you'd want to talk to to find out what they were warned about and why they didn't take the warnings more seriously.

Well, you don't have to look far to find him. He runs the 9/11 Commission. Zelikow is the
Executive Director of the Commission, which means he has operational control of the
investigation under the overall management of the two co-chairs Tom Kean and Lee
Hamilton.

Now, Zelikow is no hack. He's an accomplished Republican foreign policy hand. But
Condi Rice and what happened in the hand-off between the administrations is central
to the whole 9/11 investigation enterprise.

Does it make sense to have the guy who's running the investigation be one of her close
professional colleagues? The 9/11 families didn't think so either.

federal 9/11 Commission, Philip Zelikow, had

much closer ties to the Bush administration

than publicly disclosed. This is according to an

explosive new book by New York Times

investigative reporter Philip Shenon. It’s called The Commission: The Uncensored History of the 9/11 Investigation.


The book goes on sale today but has already created quite a stir in Washington. Philip Shenon alleges

Karl Rove, suggesting he sought to minimize

the Bush administration’s responsibility for

failing to prevent the September 11th attacks.


New York Times investigative reporter and author, Philip Shenon, joins us here in the firehouse studio. Welcome to the Democracy Now!

AMY GOODMAN: Let’s talk about Philip Zelikow, the executive director of

the 9/11 Commission. First, tell us how it was formed and then his control of the commission.


PHILIP SHENON: The commission was formed by a law passed in Congress in 2002 after a long and very tortured debate. It was a ten-member panel: five Democrats, five Republicans. The only person for the commission chosen by the White House was the chairman, initially Henry Kissinger. Kissinger stepped down, and he was replaced by Tom Kean, the governor of New Jersey. Democratic leaders in the House and Senate chose their five representatives.


Early on, after Governor Kean came on board, there was a search for an executive director, somebody to run the investigation on a day-to-day basis. There’s a polite fiction in Washington that the reports of blue ribbon commissions are written by the blue ribbon commissioners. Well, that’s not usually the case. They’re usually written by a professional staff led by a congressional researcher or a scholar. In this case, Kean and Hamilton came across the resume quite early on of Philip Zelikow, a very well respected historian at the University of Virginia. They contact him, and Zelikow agrees to come on board.


AMY GOODMAN: And he had served on the blue ribbon commission investigating the 2000 vote that got Bush elected.


PHILIP SHENON: Exactly. And he had earned the praise of both Republicans and Democrats on that commission. It’s one of the commissioners from the Electoral Reform Commission who joins the 9/11 Commission and forwards Zelikow’s name to Kean and Hamilton. And as I say, Zelikow comes on board quite early.


AMY GOODMAN: You talk about, in your book, the commission, that’s just being released this week, just being released today, Zelikow’s secret relationship with Karl Rove. He’s this week becoming a commentator on Fox News, but much more relevant was his top status within the White House, top adviser to President Bush.


PHILIP SHENON: Well, what I can tell you is that in 2003, Karl Rove called Zelikow a number of times at the commission. We know this because there are phone logs recording Rove’s calls in. Now, Zelikow had a lot of ties to the Bush administration, and that was known to some degree when he signed onto the investigation. And he had assured the commission that he would do his best to avoid the appearance of a conflict of interest and would cut off most of these ties with his friends in the White House and elsewhere.


It becomes known on the commission staff in 2003 that despite these promises, Zelikow is having conversations with, of all people, Karl Rove, and this creates, as you might imagine, a huge amount of alarm and suspicion on the commission staff. You know, what is the executive director of the 9/11 Commission doing talking to Karl Rove? Now, Rove’s people at the White House, you know, his friends and allies there, and Zelikow insist that there was — that this was completely innocent and that this involved Zelikow’s work at the University of Virginia. And indeed Zelikow’s work at the University of Virginia centered around presidential histories, so Karl Rove is somebody he would have normally at the university had some sort of contact with, I assume.


And there’s an odd development thereafter, which is Zelikow calls in his secretary, shuts the door and informs her that she is no longer to keep phone logs of his contacts with the White House. The secretary is alarmed by this, worries that she’s being asked to do something improper and then contacts the chief lawyer for the commission to alert him to what’s happened. As I say, this whole sequence creates a great alarm and a great suspicion about what Zelikow was up to.


AMY GOODMAN: We’re talking to Philip Shenon. His book has just come out. It’s called The Commission. His relationship, Philip Zelikow’s relationship with Condoleezza Rice, how far back does it go, and what does it mean for the ultimate report that comes out?


PHILIP SHENON: Well, they have a relationship that goes way back. They were both members of the National Security Council staff in the first Bush administration, Bush 41. They formed a close relationship at that point. After that presidency, Zelikow goes off to Harvard, and Rice returns to Stanford, yet they stay in touch, and they write a book together about German reunification. After President Bush 43 enters the White House, he sets up a transition team for the National Security Council at Rice’s recommendation, and Rice tasks Zelikow to join the transition team, specifically with the responsibility for reviewing counterterrorism operations at the White House.


Now, some of this was known at the time of Zelikow’s hiring. I think the question is, how much of that was known? And, of course, Rice was at the heart of the 9/11 Commission investigation. You know, it was her actions in the spring and summer of 2001 that were among the most important subjects for investigation by the 9/11 Commission, yet the commission was being run on a day-to-day basis by somebody who was undeniably a very close friend of hers.


AMY GOODMAN: I want to go to National Security Adviser Condoleezza Rice publicly testifying before the 9/11 Commission. It was April 8, 2004, an exchange between Rice and Commissioner Richard Ben-Veniste.

MY twenty-three years as the historian at the John F. Kennedy Library, in Boston, were punctuated by intensive work on sound recordings. I conducted scores of taped oral-history interviews and verified the accuracy of the transcripts, edited President John F. Kennedy's recorded telephone conversations, and, in 1981-1982, evaluated tapes made during the Cuban missile crisis, in October of 1962, as the library prepared for their declassification. The work was fascinating and exhilarating, but the poor technical quality of the tapes frequently required that I listen to the same words dozens of times, sometimes to no avail. It was, notwithstanding, a historian's ultimate fantasy -- a chance to be a fly on the wall during one of the most dangerous moments in history, and to know, within the technical limits of the recordings, exactly what happened. I spent just over a year on the tapes, and in 1983 I received an award for "careful and perceptive editing and proofreading of the JFK tapes" from the archivist of the United States. From 1983 to 1997 the library declassified twenty-two hours of tapes, and I continued to review them before each declassification.

Imagine my surprise when, in the summer of 1997, I learned that Harvard University Press was about to publish The Kennedy Tapes: Inside the White House During the Cuban Missile Crisis, edited by Ernest R. May and
Philip D. Zelikow -- complete transcripts of all twenty-two hours. Months of lead time are required to prepare a book for the printer, so I was astonished that the editors could have completed this task less than a year after the majority of the tapes were released to the public.

The editors explained that they had commissioned a team of professional court reporters to prepare a set of "draft transcripts" from the Kennedy Library tapes. Audio experts, using NONOISE, a "technically advanced noise-reduction system," had then produced an improved set of tapes, subsequently checked by the court reporters to be sure that nothing had been lost. However, May and Zelikow stressed their own responsibility for the final product.

The two of us then worked with the tapes and the court reporters' drafts to produce the transcripts printed here. The laboriousness of this process would be hard to exaggerate. Each of us listened over and over to every sentence in the recordings. Even after a dozen replays at varying speeds, significant passages remained only partly comprehensible.... Notwithstanding the high professionalism of the court reporters, we had to amend and rewrite almost all their texts. For several especially difficult sessions, we prepared transcriptions ourselves from scratch. In a final stage, we asked some veterans of the Kennedy administration to review the tapes and our transcripts in order to clear up as many as possible of the remaining puzzles. The reader has here the best text we can produce, but it is certainly not perfect. We hope that some, perhaps many, will go to the original tapes. If they find an error or make out something we could not, we will enter the corrections in subsequent editions or printings of this volume.

An unforgettable moment in these unique historical records concerns JFK's apprehension that military action in Cuba might touch off the ultimate nightmare of nuclear war, which he grimly describes at a meeting on October 18 as "the final failure." Brian McGrory, of The Boston Globe, who listened to this tape with me in 1994, after it was declassified, used those words in the lead of his article on the newly released tapes.
But when I checked the transcript recently, I was unable to find "the final failure." Certain that the editors must be right, since they had technically cleaner tapes, I listened again; there is no question that Kennedy says "the final failure." The editors, however, have transcribed it as "the prime failure."

called for Zelikow to resign, but too late.

Kristen Breitweiser and other family members of victims have their own website devoted to the investigation of 9-11. Near the bottom of their homepage, at http://www.911independentcommission.org / , this is what they say about Zelikow:

"Statement of the Family Steering Committee for The 9/11 Independent Commission
March 20, 2004

The Family Steering Committee is deeply disturbed to learn about Executive Staff Director Philip Zelikow's participation in urgent post election briefings, December 2000, and January 2001, with Sandy Berger and Condoleezza Rice. In this particular meeting the Senior Clinton Administration official clearly warned that Al Qaeda posed the worst Security threat facing the nation.

It is apparent that Dr. Zelikow should never have been permitted to be Executive Staff Director of the Commission. As Executive Staff Director his job has been to steer the direction of the Commission's investigation, an investigation whose mandate includes understanding why the Bush Administrations failed to prioritize the Al Qaeda threat. It is abundantly clear that Dr. Zelikow¡s conflicts go beyond just the transition period.

It is extremely distressing to learn this information at this late date. This new information clearly calls into question the integrity of this Commission ¡s investigation. The Family Steering Committee repeatedly expressed concerns over all members¡ conflicts requesting that the commission be forthcoming so as not to taint the validity of the report. The Family Steering Committee did not know about Dr. Zelikow's participation in this intelligence briefing until today.

As such, the Family Steering Committee is calling for:
1. Dr. Zelikow's immediate resignation.
2. Dr. Zelikow's testimony in public and under oath.
3. Subpoena of Dr. Zelikow's notes from the intelligence briefings he attended with Richard Clarke
4. The Commission to apologize to the 9/11 families and America for this massive appearance of impropriety."
