Firm waived checks, sold more toxin (Anthrax, Cholera-List Bio.Lab Tucson)

Two weeks after four Floridians were paralyzed with knockoff Botox, the laboratory that manufactured the botulinum toxin unhesitatingly sold its poisonous product to a federal undercover agent over the phone.

List may have violated at least six separate federal statutes by selling the botulinum meant for research purposes only to individuals or clinics for illegal use in humans as a knockoff Botox, wrote FDA Special Agent Susan J. Leeds in a Dec. 9 probable cause affidavit to support the search warrant.

On Monday, a federal judge found the Tucson, Ariz.-based firm bought 3,081 vials of botulinum from List and resold it to doctors, clinics and boutiques in the burgeoning anti-aging cosmetic market. U.S. District Court Judge James I. Cohn ordered a preliminary injunction against TRI, telling the firm to recall more than 2,000 vials of botulinum and cease operations.

Carlos Castillo, a spokesman for the U.S. Attorney's Office in Miami, would not comment Thursday on whether the government also would seek an injunction against List, which also sells other deadly substances such as anthrax and cholera.
