The Anne Arundel County state's attorney said yesterday he would not pursue charges against four white men in the death of a black teenager but would prosecute one of the victim's friends on a weapon charge, a decision that prompted fresh protests from civil rights leaders over the racially divisive case.

The case and its racial overtones remain the subject of a Justice Department civil rights investigation. Black leaders have called for Weathersbee's resignation, have accused his office of going easy on the white defendants and have complained of improprieties among the jurors at Fortney's trial.
Robin Jones, the victim's mother, said: "It's really difficult to believe or understand how a kid can be killed in the middle of the street, and everybody knows about it, and everybody knows who's responsible, but yet there's nobody held responsible for it. If my family were a white family, there is no way we would be going through this. No way."

"So, in essence, you have all charges being dropped against the white defendants, but against an African American defendant, charges are still being pursued," said Carl O. Snowden, an NAACP member and aide to County Executive Janet S. Owens (D) . "It comes down to appearance."
